It reveals the central moral function and creative force of reasonable disagreement in and about the law and shows why and how lawyers and legal philosophers should take reasonable conflict more seriously. Even though the law should be regarded as the primary mode of settlement of our moral conflicts,it can, and should, also be the object and the forum of further moral conflicts. There is more to the rule of law than convergence and determinacy and it is important therefore to question the importance of agreement in law and politics. By addressing in detail issues pertaining to the nature and sources of disagreement, its extent and significance, as well as the procedural, institutional and substantive responses to disagreement in the law and their legitimacy, this book suggests the value of a comprehensive approach to thinking about conflict, which until recently has been analysed in a compartmentalized way. It aims to provide a fully-fledged political morality of conflict by drawing on the analysis of topical jurisprudential questions in the new light of disagreement. Developing such a global theory of disagreement in the law should be read in the context of the broader effort of reconstructing a complete account of democratic law-making in pluralistic societies. Toward a Civil Discourse examines how, in the current political climate, Americans find it difficult to discuss civic issues frankly and openly with one another. Because America is dominated by two powerful discourses--liberalism and Christian fundamentalism, each of which paints a very different picture of America and its citizens' responsibilities toward their country-there is little common ground, and hence Americans avoid disagreement for fear of giving offence. Sharon Crowley considers the ancient art of rhetoric as a solution to the problems of repetition and condemnation that pervade American public discourse. Crowley recalls the historic rhetorical concept of stasis--where advocates in a debate agree upon the point on which they disagree, thereby recognizing their opponent as a person with a viable position or belief. Most contemporary arguments do not reach stasis, and without it, Crowley states, a nonviolent resolution cannot occur. Toward a Civil Discourse investigates the cultural factors that lead to the formation of beliefs, and how beliefs can develop into densely articulated systems and political activism. Crowley asserts that rhetorical invention (which includes appeals to values and the passions) is superior in some cases to liberal argument (which often limits its appeals to empirical fact and reasoning) in mediating disagreements where participants are primarily motivated by a moral or passionate commitment to beliefs. Sharon Crowley examines numerous current issues and opposing views, and discusses the consequences to society when, more often than not, argumentative exchange does not occur. She underscores the urgency of developing a civil discourse, and through a review of historic rhetoric and its modern application, provides a foundation for such a discourse-whose ultimate goal, in the tradition of the ancients, is democratic discussion of civic issues.

From the pundits to the polls, nearly everyone seems to agree that US politics have rarely been more fractious, and calls for a return to “civil discourse” abound. Yet it is also true that the requirements of polite discourse effectively silence those who are not in power, gaming the system against the disenfranchised. What, then, should a democracy do? This book makes a case for understanding civility in a different light. Examining the history of the concept and its basis in communication and political theory, William Keith and Robert Danisch present a clear, robust analysis of civil discourse. Distinguishing it from politeness, they claim that civil argument must be redirected from the goal of political comity to that of building and maintaining relationships of minimal respect in the public sphere. They also take into account how civility enables discrimination, indicating conditions under which uncivil resistance is called for. This book is about a widely shared desire: the desire among citizens for a vibrant and effective social discourse of legitimation. It therefore begins with the conviction that what political philosophy can provide citizens is not further theories of the good life but instead directions for talking about how to justify the choices they make—or, in brief, "just talking." As part of the general trend away from the aridity of Kantian universalism in political philosophy, thinkers as diverse as Bruce Ackerman, Jürgen Habermas, Alasdair MacIntyre, and Richard Rorty have taken a "dialogic turn" that seeks to understand the determination of principles of justice as a cooperative task, achieved in some kind of social dialogue among real citizens. In one way or another, however, each of these different variations on the dialogic model fail to provide fully satisfactory answers, Mark Kingwell shows. Drawing on their strengths, he presents another model he calls "justice as civility," which makes original use of the popular literature on etiquette and work in sociolinguistics to develop a more adequate theory of dialogic justice.
