The Bocconi University’s Department of Legal Studies is proud to launch its Legal Studies Series with this debut volume, bringing together Arthur R. Miller and Helen Hershkoff, two esteemed U.S. professors of civil procedure with Bocconi professors Marta Cartabia and Cesare Cavallini for a public discussion of class actions and other new and emergent forms of aggregate litigation. Bocconi Rector Francesco Billari presided and emphasized the significance of the class action to the core mission of the Department of Legal Studies, namely, protection and expansion of justice. The far-ranging remarks focused on the origin and development of the class action, its utility in challenging racial and gendered inequalities, as well as market defects, and the potential—and limits—of aggregate litigation to resolve some of the most critical issues of our times, touching on technological change, environmental degradation, economic inequality, and democratic decline. Readers will find this volume to be not only informative, but also inspiring in its passion for justice.

In class actions, attorneys effectively hire clients rather than act as their agent. Lawyer-financed, lawyer-controlled, and lawyer-settled, this entrepreneurial litigation invites lawyers to act in their own interest. John Coffee’s goal is to save class action, not discard it, and to make private enforcement of law more democratically accountable.

This monograph addresses the phenomenon of mass harm and how it may be resolved through collective redress. It examines particularly how such redress may be achieved through mechanisms such as multi-party actions (MPAs). In order to do this, an analytical framework is created against which to evaluate various multi-party procedures. This is illustrated through the experience of a selection of common law jurisdictions in dealing with mass harm – namely that of England and Wales, Canada, Australia and the United States, as well as that of EU collective redress. It examines multi-party action laws benchmarked against the objectives identified in the analytical framework. The phenomenon of environmental mass harm in particular is explored as a case study, as it illustrates some of the difficulties that may arise in mass harm litigation. Also, this work explores where the best solutions for mass harm redress may lie in the future – perhaps in collective actions or through alternatives such as regulation and alternative dispute resolution or a combination of these. Finally, the experience of mass harm litigation in Ireland is examined, as currently this jurisdiction does not have an effective mechanism for dealing with mass harm. This title is included in Bloomsbury Professional's International Arbitration online service.

Mass Justice written by Jenny Steele and has been published by Edward Elgar Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-07 with Business & Economics categories.

This insightful book considers phenomena such as mass torts, which affect numerous victims, and complex insolvency cases, which concern multiple and often competing interests. The editors identify and respond to the need for reflection on the notion of ?mass justice?. The assembled contributors show that while private law is usually debated in terms of individual rights and duties, the reality is that these are deeply influenced by collective issues. They address examples such as the operation of class actions; the availability of insurance funds; the logistics of negotiating with and compensating a wide range of individuals; as well as distribution of assets in insolvency proceedings. This unique and detailed book will appeal to academics and students of private law as well as those with an interest in law and society. Scholars from non-law disciplines with an interest in insurance and liability will also find this study thought-provoking, as will practitioners and policy-makers.
