Le Code annoté de la Cour pénale internationale (2008) est le troisième volume d'une collection annuelle. Il propose une sélection des extraits les plus pertinents des décisions publiques rendues par la Cour en 2008. 2008 marque un tournant majeur dans l'acitivité judiciaire de la Cour. 472 décisions délivrées, ou rendues publiques, en 2008 ont été analysées au cours de la préparation du présent volume, ce qui constitue une augmentation supérieure à 100% par rapport au nombre de décisions rendues au cours de l'année précédente. Ces décisions addressent certains thèmes majeurs tels que les éléments constitutifs des crimes contre l'humanité et des crimes de guerre, le droit des victimes à participer aux différents stades de la procédure devant la Cour, les droits de la défense - en particulier les garanties du procès équitable et l'obligation faite au Procureur de communiquer à la Défense la totalité des éléments de preuve potentiellement à décharge en sa possession -, etc. L'année est également marquée par deux nouvelles arrestations, une en relation avec la situation en République démocratique du Congo (Mathieu Ngudjolo Chui), l'autre en relation avec la situation en République Centrafricaine (Jean-Pierre Bemba) et la confirmation des charges dans le premier dossier joint Le Procureur c. Katanga et Ngudjolo. Enfin, 2008 constitue l'année de préparation des deux premiers procès devant la Cour.

Depuis l’entrée en vigueur de son Statut, le 1er juillet 2002, la Cour pénale internationale (CPI) a commencé à travailler. Les premières Situations (République Démocratique du Congo, Ouganda, République Centrafricaine et Soudan) et affaires (Lubanga, Kony, Otti, Lukwyia, Odhiambo, Ongwen, Katanga, Ngudjolo) sont à présent pendantes devant la Cour. Les premières décisions publiques datent de juillet 2004. Plus de 250 décisions publiques ont été rendues en date du 31 décembre 2006. Le Code annoté de la Cour pénale internationale (2004-2006) est le premier volume d’une collection. En fonction du nombre de décisions rendues par la Cour dans l’avenir, un nouveau volume sera publié chaque année ou tous les deux ans. Le Code propose une sélection des extraits les plus pertinents des décisions publiques rendues par la Cour entre juillet 2004 et le 31 décembre 2006. Les extraits proposés ont été sélectionnés sur la base des critères suivants : 1) extraits qui clarifient un point de droit, interprètent l’une des dispositions statutaires de la Cour... ; 2) extraits qui montrent comment une règle spécifique est concrètement appliquée par la Cour ; 3) extraits pertinents du point de vue de l’évolution de la justice internationale, des droits de l’homme, du droit international humanitaire... Les extraits sont proposés dans leur version française officielle, chaque fois qu’elle est disponible ou dans leur version anglaise originale. Dans tous les cas, un résumé en français identifie de façon claire l’apport de l’extrait par rapport aux critères de sélection. Les extraits sont classifiés par rapport à la disposition statutaire (article du Statut, règle du Règlement de procédure et de preuve, norme du Règlement de la Cour) à laquelle ils se rapportent. Un numéro d’identification rapide facilite le renvoi aux extraits des autres décisions sélectionnés dans le présent volume. La présente collection de Codes annotés est avant tout conçue comme un outil à l’usage des praticiens du droit pénal international et des universitaires, qui, grâce au numéro d’identification rapide et à l’index thématique, y trouveront le moyen d’identifier immédiatement les extraits les plus pertinents de la jurisprudence de la Cour sur chaque sujet.

The International Criminal Court was established from the July 1, 2002, entry into force of the Rome Statute. The first decisions rendered by the Court were published in July 2004, and by the end of December 2006, the number of decisions had reached 230. The Annotated Digest of the International Criminal Court, 2004-2006, is the first volume in a series that compiles the most significant legal findings from public decisions rendered by the International Criminal Court. In total, 230 decisions were reviewed for the preparation of the present volume, which examines the decisions issued from 2004 and 2006. The abstracts selected for inclusion in this volume concern the first situations referred to the Court by the Democratic Republic of the Congo, the Central African Republic, and the Sudan, as well the initiation of cases against Thomas Lubanga Dyilo, Joseph Kony, Vincent Otti, Raska Lukwiya, Okot Odhiambo, and Dominic Ongwen. Abstracts were selected based on the following criteria: (i) clarification of a legal issue or interpretation of a legal provision; (ii) implementation or application of a legal provision; and (iii) meaningfulness with respect to international justice, human rights, or international humanitarian law. Abstracts are quoted in their original language, and a summary in English is included where only a French-language passage is available. Each abstract is organized under the relevant Statute, Rule of Procedure and Evidence, or Regulation of the Court, together with a short description of the topic. The Digest series is intended, foremost, as a tool for international criminal law practitioners and academics interested in public humanitarian law and the work of the Court. An index and reference guide is provided to facilitate cross-referencing among the volumes in the series.

The Annotated Digest of the International Criminal Court (2004-2006) is the first volume of an annual or biennial series, depending on the volume of decisions issued. It compiles a selection of the most significant legal findings contained in the public decisions rendered by the International Criminal Court since its first decisions in July 2004 until 31 December 2006. More than 230 decisions have been reviewed for the preparation of the present volume. The criteria for selection of the abstracts are: 1) abstracts which clarify a point of law, interpret a rule; 2) abstracts which show how a specific rule is applied by a Chamber; 3) abstracts which are otherwise meaningful with respect to international justice, human rights, international humanitarian law. The abstracts are quoted in their original language, namely English or French. An English translation of the French abstracts is given. The abstracts are inserted after the relevant articles of the Statute, Rules of Procedure and Evidence and Regulations of the Court, with a short description/summary of their precise topic. A quick reference system makes it easy to refer to other decisions quoted elsewhere in the Digest.

The Annotated Digest of the International Criminal Court, 2008, is the third volume in an annual series, which compiles a selection of the most significant legal findings from public decisions rendered by the International Criminal Court in 2008. The selected abstracts include an extraordinary number of landmark decisions on substantive and procedural issues including, among others, the constitutive elements of crimes against humanity and war crimes, the rights of victims to participate in different stages of proceedings, the guarantees of a fair trial, and the prosecutorial obligation to disclose potentially exculpatory evidence in its possession. The year was marked by two new arrests, one in the situation from the Democratic Republic of Congo (Ngudjolo), the other in the situation from the Central African Republic (Bemba), as well as confirmation of charges in the joint case The Prosecutor v. Katanga and Ngudjolo. Finally, 2008 paved the way for commencement of the first trials in the history of the International Criminal Court, which officially began in 2009. Abstracts included in this series were selected based on the following criteria: (i) clarification of a legal issue or interpretation of a legal provision; (ii) implementation or application of a legal provision; and (iii) meaningfulness with respect to international justice, human rights, or international humanitarian law. Passages are normally quoted in English, except where the English translation has not been made available; in such circumstances, abstracts are provided in French with an accompanying English-language summary.
