Este libro es el fruto del trabajo y la reflexión que llevamos a cabo a lo largo de dos años en el seminario de investigación "Democracia y derechos humanos" de la Flacso México (en adelante el seminario). En este participan tanto profeso- res como estudiantes de diversas instituciones académicas. Se trata de un espacio amplio y abierto para discutir los temas que nos conforman como grupo de investigación1. En estos dos primeros años el tema que discutimos —y que conforma el objetivo principal de este libro— giró en torno a las diferentes relaciones entre la violencia y los derechos humanos. Es probable que la principal conclusión sea que existen diferentes puntos de contacto entre la violencia y los derechos humanos, según como se les conciba. Un primer punto de contacto está vinculado con el aumento en la región latinoamericana de la violencia directa y abierta durante los últimos veinte años, pero también con el aumento de la violencia estructural y encubierta y con la manera como el discurso, las normas o las instituciones estatales y no estatales conciben los derechos humanos. A partir de ello encontramos diferentes formas de concebir la violencia y los derechos humanos, lo cual también marca diferentes formas de relación entre ellos. Un segundo punto de contacto entre la violencia y los derechos humanos está vinculado con el rol del Estado. Este aparece como problema y como solución; como organización violadora de los derechos humanos o como dispositivo burocrático a través del cual se moderan las demandas de justicia; o bien como solución a los problemas de derechos humanos producto de las situaciones de violencia ejercida por medio del desempeño de sus instituciones.
