It identifies key factors that are responsible for the development of Somali piracy and the actors which aim to stop it. Furthermore, the report addresses the legal, social, militaristic, economic, and political complications that arise from varying international strategies to effectively combat policy. The report outlines several underlying historical and geographical factors followed by the impacts that Somalia has faced in terms of its central government’s collapse in 1991. As is discussed, Somalia as a failed state has allowed for piracy to flourish in conjunction with the described underlying factors. It also describes the cyclical trend, or feedback loop, that many of these factors have for promoting piracy while piracy in return antagonizes the issues caused by these factors. The obstacles towards combating piracy are also discussed demonstrating the difficult scenario that policymakers will need to address in order to effectively treat the cause of piracy. In order to identify the contradiction that exists pertaining to the issue of Somali piracy, this report will focus on Somalia’s fractured society and its incompatibility with international democratic norms. As will become evident, the reduction of piracy hinges on the ability for Somalia’s central government to stabilize. However, due to the mentioned fractured society within Somalia, the ability to develop a stable and functional democratic government is in direct conflict with the nature of Somali society.

Maritime piracy off the coast of Somalia was first recognised as a global concern in 2008 after the hijackings of World Food Programme vessels. It remains a serious impediment to international maritime trade and a significant risk to seafarers. Bringing a criminological perspective to the subject, this book presents an analysis of Somali piracy by means of Routine Activity Theory and regulatory pluralism. Based on data from a range of sources, including published documents and in-depth interviews with representatives of industry, government, and international organisations, the study concludes that no one institution or policy will suffice to control Somali piracy. Accordingly, a number of different actors and institutions have a role to play in reducing the supply of motivated offenders, the vulnerability of prospective victims, and in enhancing guardianship. The book envisages a holistic counter-piracy program based on a pluralistic regulatory model that is sustainable within the region, and managed by the region, providing the best opportunity for both the immediate future, and for long-term success. This study will be essential reading for criminologists, public policy and legal scholars, as well as policy makers and regulators in countries affected by and dealing with piracy, and international professional advocacy groups operating in the maritime space.

Global maritime piracy has remained a challenge for the community of states since antiquity. The scope, nature and context of this practice has spawned various responses and policies among nations to deal with it. In recent times, incidences of piracy off the coast of Somalia have increased, making the Gulf of Aden the epicenter of pirate activities today. The international law governing armed conflict is at a crossroads, as the formal framework of laws designed to control the exercise of self-defense and conduct of inter-state conflict finds itself confronted with violent 21st Century disputes of a very different character. Military practitioners who seek to stay within the bounds of international law often find themselves applying bodies of law-IHRL, IHL, ICL-in an exclusionary fashion, and adherence to those boundaries can lead to a formal and often rigid application of the law that does not adequately address contemporary security challenges. Fighting at the Legal Boundaries offers a holistic approach towards the application of the various constitutive parts of international law. The author focuses on the interaction between the applicable bodies of law by exploring whether their boundaries are improperly drawn, or are being interpreted in too rigid a fashion. Emphasis is placed on the disconnect that can occur between theory and practice regarding how these legal regimes are applied and interact with one another. Through a number of case studies, Fighting at the Legal Boundaries explores how the threat posed by insurgents, terrorists, and transnational criminal gangs often occurs not only at the point where these bodies of law interact, but also in situations where there is significant overlap. In this regard, the exercise of the longstanding right of States to defend nationals, including the conduct of operations such as hostage rescue, can involve the application of human rights based law enforcement norms to counter threats transcending the conflict spectrum. This book has five parts: Part I sets out the security, legal, and operational challenges of contemporary conflict. Part II focuses on the interaction between the jus ad bellum, humanitarian law and human rights, including an analysis of the historical influences that shaped their application as separate bodies of law. Emphasis is placed on the influence the proper authority principle has had in the human rights based approach being favored when dealing with "criminal" non-State actors during both international and non-international armed conflict. Part III analyzes the threats of insurgency and terrorism, and the state response. This includes exploring their link to criminal activity and the phenomenon of transnational criminal organizations. Part IV addresses the conduct of operations against non-State actors that span the conflict spectrum from inter-state warfare to international law enforcement. Lastly, Part V looks at the way ahead and discusses the approaches that can be applied to address the evolving, diverse and unique security threats facing the international community.

A couple of weeks ago yet another ship has been captured. According to the International Maritime Organization (IMO) data, there had been more pirate attacks reported in the first quarter of 2009 than in the entire previous year, whereas Somali pirates had undertaken half of those. It seems as if the twenty-first century is competing against the seventeenth. Put differently, combating piracy off the Somali coast might now be considered an analogy to the fight against international terrorism following September 11. Being considered a rather regional problem so far, piracy off the coast of Somalia has taken on international implications since more than 20,000 ships a year are passing Somali waters carrying about 8 % of the world’s trade of goods and commodities. This very important route – through the Gulf of Aden – is threatened continuously by pirates affecting international commercial shipping, fishing and humanitarian aid supply. In the first step this paper will introduce the region as well as the setting of the crisis and offer a pragmatic definition of the act of piracy. Subsequently it will outline the extent to which the crisis causes significant concerns and point out its impact not only on Somalia but also on international trade, the environment and security; altogether stirring vitally important areas of international freedom. In the second step it will cover the actions taken by the international community, especially the United Nations Organizations, and approach proposals to resolve the conflict. The consequential arguments represent the bridging to the third part which will summarize the points at issue and conclude with questions offering incentives to alternative approaches.
