Il Talmud è il testo centrale del giudaismo rabbinico e la fonte primaria della legge religiosa ebraica (halakha) e della teologia ebraica. La Mishnah o Mishna è la prima grande raccolta scritta delle tradizioni orali ebraiche conosciuta come la Torah orale. È anche la prima grande opera della letteratura rabbinica. La Mishnah fu redatta da Giuda ha-Nasi all'inizio del III secolo EV in un periodo in cui, secondo il Talmud,la persecuzione degli ebrei e il passare del tempo hanno sollevato la possibilità che i dettagli delle tradizioni orali dei farisei del periodo del Secondo Tempio (536 aEV - 70 dC) sarebbero stati dimenticati. La Gemara è la componente del Talmud che comprende l'analisi rabbinica e il commento della Mishnah. Dopo che la Mishnah fu pubblicata da Giuda il Principe (intorno al 200 d.C.), l'opera fu studiata in modo esaustivo di generazione in generazione di rabbini in Babilonia e nella Terra d'Israele. Le loro discussioni furono scritte in una serie di libri che divennero la Gemara, che quando combinata con la Mishnah costituì il Talmud. Secondo il giudaismo rabbinico, la Torah orale o Legge orale rappresenta quelle leggi, statuti e interpretazioni legali che non sono state registrate nei Cinque Libri di Mosè, la "Torah Scritta",ma nondimeno sono considerati dagli ebrei ortodossi come prescrittivi e dati allo stesso tempo.
