L’udienza preliminare è il baricentro del processo penale nei confronti del minore autore di reato, poiché risulta connotata da numerose e significative peculiarità che la distinguono qualitativamente dall’omologa fase del rito degli adulti: la collegialità e specializzazione dell’organo giudicante, la partecipazione dell’imputato e la sua audizione da parte del giudice, l’assistenza di difensori dotati di specifica formazione, l’intervento di una pluralità di soggetti con funzioni d’integrazione dell’autodifesa o di supporto affettivo e psicologico a favore della persona in età evolutiva, gli accertamenti sulla personalità e, ove necessario, sull’età del reo, e soprattutto l’ampio ventaglio di soluzioni terminative, che consentono la definizione anticipata del processo, nonché, infine, l’opposizione quale eventuale rimedio avverso la decisione. L’approfondimento di questi temi, accompagnato da un’apposita e recente indagine empirica svolta presso la giurisdizione specializzata milanese, allo scopo di creare un legame tra riflessione scientifica e prassi operativa, si pone decisamente nell’attuale prospettiva della “riforma Cartabia”, che ha voluto salvaguardare e rivalutare l’udienza preliminare, come importante momento di garanzia processuale, e assume rilevanza in chiave comparativa con il processo comune, dove essa finora ha registrato, nell’applicazione pratica, un insignificante e deludente rendimento in termini di controllo giurisdizionale sull’esercizio dell’azione penale.
