The U.S. Department of Energy's most recent commercial energy code compliance methodology and associated tools focused on determining a percent compliance rating for states to support the American Recovery and Reinvestment Act of 2009. That approach included a checklist of code requirements, each of which was graded pass or fail. Percent compliance for any given building was the percent of individual requirements that passed. This research set out to develop and test a new methodology capable of determining, for a sample of buildings, how much energy cost savings could potentially be gained through better compliance with the code. To estimate this, this research assigned a lost energy cost value to any condition likely to be encountered in a compliance assessment.

Most state energy codes in the United States are based on one of two national model codes; ANSI/ASHRAE/IES 90.1 (Standard 90.1) or the International Code Council (ICC) International Energy Conservation Code (IECC). Since 2004, covering the last four cycles of Standard 90.1 updates, about 30% of all new requirements have been related to building controls. These requirements can be difficult to implement and verification is beyond the expertise of most building code officials, yet the assumption in studies that measure the savings from energy codes is that they are implemented and working correctly. The objective of the current research is to evaluate the degree to which high impact controls requirements included in commercial energy codes are properly designed, commissioned and implemented in new buildings. This study also evaluates the degree to which these control requirements are realizing their savings potential.

Energy efficiency requirements in current commercial building energy codes vary across states. Energy standards that are currently adopted by states range from ASHRAE 90.1 1999 to ASHRAE 90.1 2007. Some states do not have a code requirement for energy efficiency, leaving it up to the locality or jurisdiction to set their own requirements. The six National Institute of Standards and Technology (NIST) Special Publications (1147, 1148-1, 1148-2, 1148-3, and 1148-4) use the Building Industry Reporting and Design for Sustainability (BIRDS) database to analyze the impacts that the adoption of newer, more efficient commercial building energy codes would have on building energy use, operational energy costs, building life-cycle costs, and energy related carbon emissions for each state by Census Region. This study summarizes the results from the series of documents for each of the 50 states into a two-page section.
