Competition and the State analyzes the role of the state across a number of dimensions as it relates to competition law and policy across a number of dimensions. This book re-conceptualizes the interaction between competition law and government activities in light of the profound transformation of the conception of state action in recent years by looking to the challenges of privatization, new public management, and public-private partnerships. It then asks whether there is a substantive legal framework that might be put in place to address competition issues as they relate to the role of the state. Various chapters also provide case studies of national experiences. The volume also examines one of the most highly controversial policy issues within the competition and regulatory sphere—the role of competition law and policy in the financial sector. This book, the third in the Global Competition Law and Economics series, provides a number of viewpoints of what competition law and policy mean both in theory and practice in a development context.

I. The concept of competition played a central role in the very first attempts to apply the tools of economics to the analysis of politics. Adopting Hotelling's (1929) industrial organization model of imperfect competition in markets in which space has a predominant role, Downs (1957), following on some perceptive insights of Schumpeter (1942), was able to formulate a model of electoral competition in which political parties, seeking the support of citizens, compete against each other in offering policies designed to elicit their vote. Downs' model and the numerous variants to which it gave birth soon became the major component of what was to become Public Choice Theory. The enormous efforts of the last 30 years devoted to modelling electoral competition have helped improve our understanding of politics and have contributed a basic element that undoubtedly will remain essential to any reasonably complete theory of politics. But whatever may have been early expectations, it is now clear that electoral competition will only be one such element. More recently, the idea of competition has been used to model interest-group behavior. Becker (1983), building on earlier work by Bentley (1908), Truman (1958), Olson (1965), Stigler (1971) and Peltzman (1976), applied the Public Finance analysis of the excess-burden of taxes and subsidies - to which, incidentally, Hotelling (1938) had made pioneering contribution- to produce a model in which competition between interest groups determines an equilibrium distribution of income.

States influence competition in the market in various ways. They often act themselves as market participants through state-owned enterprises. They regulate markets and specific sectors of the economy such as public utilities in particular. In some instances, market regulation explicitly aims to promote competition in the market. In the five hundred years covered by this volume there was scarcely a year which passed without either war or some open demonstration of hostility between the many sovereign powers which governed Europe. States and peoples lived under the shadow of war, were ceaselessly prompted to consider the possibility of war, had to find ways of dealing with the consequences of war. This volume in the Origins of the Modern State in Europe series focuses on the crucial role of war in the formationof state systems. It starts from the assumption that interstate rivalries and conflicts were at the heart not only of the demarcation of territories, but also of the ever-growing need to mobilize resources for warfare. Institutionalization was consequently highly dependent on such competition. It was for military reasons, and with military aims, that the state secured control of time and space, both at sea and on land. The Origins of the Modern State in Europe series arises from an important international research programme sponsored by the European Science Foundation. The aim of the series, which comprises seven volumes, is to bring together specialists from different countries, who reinterpret from a comparative European perspective different aspects of the formation of the state over the long period from the beginning of the thirteenth to the end of the eighteenth century. By tracing the evolution of South Korean state-led capitalism and comparing it with other economies, this book critiques prevalent theories including neoliberalism, the developmental state, and institutionalism, and proposes a theoretical alternative focusing on endogenous changes through elites' competition within and outside the state. Unlike the arguments of neoliberals, this volume asserts that the state can still play an active role in reconstituting the national economy through globalization. The Korean state successfully fosters economic growth by nurturing industrial commons through globalization, rather than by adopting a neoliberal free-market system. This volume exerts that the Korean economy has successfully grown over the past 50 years because it has moved toward a new version of state-led developmentalism. In order to better account for the evolution of state-led developmentalism, this book proposes changes by competition within, as well as outside, the state, in order to bring about changes in developmentalism and the ability to adjust to new contexts. Unlike prevalent accounts of developmental state theory, Changes by Competition argues that the state is neither unitary nor cohesive, but a locus of competition.
