The conduct of warfare is constantly shaped by new forces that create complexities in the battlespace for military operations. As the nature of how and where wars are fought changes, new challenges to the application of the extant body of international law that regulates armed conflicts arise. This inaugural volume of the Lieber Studies Series seeks to address several issues in the confluence of law and armed conflict, with the primary goal of providing the reader with both academic and practitioner perspectives. Featuring chapters from world class scholars, policymakers and other government officials; military and civilian legal practitioners; and other thought leaders, together they examine the role of the law of armed conflict in current and future armed conflicts around the world. Complex Battlespaces also explores several examples of battlespace dynamics through four "lenses of complexity": complexity in legal regimes, governance, technology, and the urbanization of the battlefield.

This book presents the deep subject-matter understanding gained by a mid-career U.S. Air Force officer who as a Research Fellow engaged in a year-long quest for insight into asymmetric conflict analysis and synthesis. During the year, through innumerable exchanges with expert counterterrorism practitioners inside and outside of government, he acquired a first-hand appreciation of how intelligence can more systematically build and employ a capability to gain ground in this challenging environment. His formulation, presented here in an accessible, systematic manner that makes it suitable as a handbook for practitioners at any level, goes well beyond any existing guidance yet assembled in one package. This product has been reviewed by senior experts from academia and government, and has been approved for unrestricted distribution by the Office of Freedom of Information and Security Review, Washington Headquarters Services. It is available to the public through the National Technical Information Service (www.ntis.gov).

There are legal limits on the circumstances under which states may use military force to address a perceived or actual threat. Necessity and Proportionality in International Peace and Security Law explores the many ways in which necessity and proportionality arise in the law on the modern battlefield, which is rapidly changing, complex, and ambiguous.

Conflict Refugees written by Christel Querton and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-08-10 with Law categories.
Based on a systematic and empirical comparative study of six European Union countries, Christel Querton explores judicial decision-making in the context of persons fleeing armed conflicts in the EU. Addressing and redressing misconceptions about the relevance of the Refugee Convention, this book demonstrates how appellate authorities across the EU approach situations of armed conflict predominantly through outdated understandings of warfare and territoriality. Thus, they apply a higher standard of proof than is warranted by international refugee law. Adopting a gender perspective, Querton also shows how appellate authorities fail to acknowledge the gender-differentiated impact of armed conflicts. Drawing from gender and security studies, this book proposes an original conceptual framework which, supported by existing international legal standards, reframes the definition of 'refugee' and better reflects the reality of violence in modern-day conflicts. In doing so, it re-asserts the Refugee Convention as the cornerstone of international protection.

Lawfully Using Autonomous Weapon Technologies written by Jonathan Kwik and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-08-02 with Law categories.
This monograph provides a practical and operational perspective to the question of how to lawfully employ autonomous weapon systems (AWS) from the point-of-view of the technology's end-users: field commanders. While there is international consensus that targeting rules such as proportionality and precautions must be respected when using AWS, there is legal and practical ambiguity as to how to translate this normative commitment into practice. How are commanders in the field, when guns are already blazing, expected to exercise command-and-control when ordering AWS-attacks, and ensure that their targeting obligations remain fulfilled? The book discusses how commanders can use existing targeting frameworks to ensure that their use of AWS remains in compliance with the rules governing the conduct of hostilities. It invites the reader to step into the shoes of the military commander with all the operational pressure and uncertainty inherent to this position, and explores amongst others: - How to maintain control of AWS throughout a targeting cycle; - How to make informed and reasoned deployment decisions by analysing information related to the technical parameters of the AWS, the characteristics of the operational environment, and enemy countermeasures; - Under which circumstances AWS may not be used under targeting rules, such as indiscriminate attack, proportionality and the duty to cancel/suspend; - What extra precautionary measures unique to AWS technology can and should be employed; - When it is militarily desirable to employ AWS over other alternatives; and - Under what circumstances criminal liability may be attributed for AWS-related harm. It offers both academic and practical outputs: new legal and doctrinal insights on the technology that is useful for future legal developments, and workable recommendations and efficient flowcharts that can be adopted by commanders, military organisations or policymakers to ensure IHL-compliant deployment of AWS. Dr. Jonathan Kwik is a researcher at the T.M.C. Asser Institute in The Hague specialised in artificial intelligence and targeting law, and is a member of the Board of Experts of the Asia-Pacific Journal of International Humanitarian Law.

International Law And The Classification Of Conflicts written by Elizabeth Wilmshurst and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 2012-08-02 with Law categories.
This book comprises contributions by leading experts in the field of international humanitarian law on the subject of the categorisation or classification of armed conflict. It is divided into two sections: the first aims to provide the reader with a sound understanding of the legal questions surrounding the classification of hostilities and its consequences; the second includes ten case studies that examine practice in respect of classification. Understanding how classification operates in theory and practice is a precursor to identifying the relevant rules that govern parties to hostilities. With changing forms of armed conflict which may involve multi-national operations, transnational armed groups and organized criminal gangs, the need for clarity of the law is all-important. The case studies selected for analysis are Northern Ireland, DRC, Colombia, Afghanistan (from 2001), Gaza, South Ossetia, Iraq (from 2003), Lebanon (2006), the so-called war against Al-Qaeda, and future trends. The studies explore the legal consequences of classification particularly in respect of the use of force, detention in armed conflict, and the relationship between human rights law and international humanitarian law. The practice identified in the case studies allows the final chapter to draw conclusions as to the state of the law on classification.
