I would like to focus my remarks today on an examination that the lawyers committee has done of this screening process, particularly in Hong Kong, and problems that we have identified with it. As you know, the cpa required the introduction into the region of a consistent refugee status determination process to be con ducted in accordance with national legislation and internationally accepted practice. However, despite this noble goal at the outset, refugee screening under the cpa has been seriously flawed. The 1951 Convention Relating to the Status of Refugees and the 1967 Protocol Relating to the Status of Refugees are the two primary international legal instruments that states use to process asylum seekers' claim to refugee status. However, in Southeast Asia only two states have acceded to these instruments. This is seemingly paradoxical for a region that has been host to a large number of asylum seekers who, as a result, are forced to live as ‘illegal migrants’. This book examines the region's continued rejection of international refugee law through extensive archival analysis and argues that this rejection was shaped by the region’s response to its largest refugee crisis in the post-1945 era: the Indochinese refugee crisis from 1975 to 1996. The result is a seminal study into Southeast Asian's relationship with international refugee law and the impact that this has had on states surrounding the region, the UNHCR and the asylum seekers themselves.

This paper contains four distinct parts relating to the preparation for the Second International Conference on Indo-Chinese Refugees held in Geneva in June 1989. The Introduction presents the developments which led up to the decision to convene the Conference, beginning with the foreign ministers meeting of the Association of South-East Asian Nations (ASEAN) in Bangkok in 1988 and a Preparatory Conference in Kuala Lumpur in March 1989. It was during this latter meeting that a draft proposal for a Comprehensive Plan of Action for achieving durable solutions to the region's refugee problem was approved. The second section describes the refugee situation in South East Asia and the 1979 Geneva Meeting designed to establish the basic framework for responding to the exodus of refugees in the region. The breakdown of the system for handling the situation and the lack of a workable range of humane alternatives led, according to the report, to ASEAN's appeal. The third brief section describes the various conferences held and the preparation for the Comprehensive Plan of Action. The fourth section is the Plan itself, which includes a broad framework for attacking the root causes of mass exodus while more firmly establishing international responsibility. The Plan has four major areas: it moves towards a de-coupling of the provision of first asylum from a prerequisite by countries outside the region to large-scale resettlement of Vietnamese; it seeks more regular relationships with Viet Nam regarding departure and return; movements of people out of Viet Nam and Laos are to be handled in a humanitarian manner; the Plan suggests the possibility of alternatives to voluntary return of those who do not meet the criteria for consideration as refugees.

This issue of the International Journal of Refugee Law is devoted to the Comprehensive Plan of Action (CPA) for Indo-Chinese asylum seekers in South East Asia, a regional agreement aimed at resolving the problem of outflows from Vietnam. Under the agreement, resettlement offers were no longer to be linked to the simple fact of departure, but to "recognized refugees" only. Recognition was to be determined by a consistent refugee status determination process. The idea of a region-wide status determination policy is unique and forms the focus for this issue, which draws on papers prepared for a 1992 colloquium in Manila, organized by the Jesuit Refugee Service Asia/Pacific. Andrew Shacknove analyzes the current shift, among affluent states, away from a commitment to offering asylum towards a policy of containment in or near the country of origin. Sten Bronée provides a history of the origins of the CPA, while Arthur Helton and Roda Mushkat assess the refugee status determination process, the former in relation to the region as a whole, the latter with special reference to Hong Kong. The final paper is by Carole McDonald and offers an account of the damaging effects of detention on unaccompanied minors and other children as a consequence of CPA procedures and delays. The full texts of the CPA and the 1988 Memorandum of Understanding betweenUNHCR and Vietnam are included.
