A expressão "patrimônio cultural brasileiro" é adotada pela Constituição de 1988 para designar os bens materiais e imateriais, tomados individualmente ou em conjunto, que fazem referência à identidade, à ação e à memória dos diferentes grupos formadores da sociedade brasileira. A referencialidade é, portanto, um princípio que baliza a atuação do poder público e assegura a colaboração da comunidade para a seleção, a promoção e a proteção do patrimônio cultural. No Brasil, a competência administrativa relacionada ao patrimônio cultural é comum a todos os entes da federação. Esse esquema de distribuição de competências encontra desafios que precisam ser superados para uma adequada proteção, como o de assegurar que os entes da federação tenham uma atuação eficiente e colaborativa a partir da aplicação do princípio da subsidiariedade, e o de tornar efetiva a participação da comunidade na seleção dos bens culturais a serem protegidos pelo tombamento. Assim, a presente obra estuda o patrimônio cultural, a democracia e o federalismo com o propósito de delinear os seus suportes teórico e normativa para dar sustentação à proposta de inversão na primazia do pacto federativo, transladando-a da União para os Municípios e as comunidades locais.

For many years, the fields of citizenship education and participatory democracy have often operated independently from each other. During the last decade, the Transformative Learning Centre of the University of Toronto has nurtured multiple spaces for an interdisciplinary dialogue among scholars, practitioners and students from these two fields. One of those spaces was the Second International Conference on Citizenship Learning and Participatory Democracy, where close to 300 participants from all over the world shared ideas in more than 150 sessions, including discussions, round-tables, workshops and keynote addresses. This volume brings together a selected collection from the many papers submitted to the conference. Learning Citizenship by Practicing Democracy: International Initiatives and Perspectives includes an introductory essay, 18 chapters and a postscript, and is organized in three sections: I. This volume proposes an alternative development paradigm to the existing capitalist extant one, and studies how it is distinctly different from the older system. Rooted in the principles of solidarity between humans, as well as between humans and nature, this alternative paradigm replaces the methodological individualism of capitalism by ‘reciprocal altruism’, a new logic of capital, to give pace and direction to the development process.
