O tema central deste livro é a relação entre direito e moral. O positivismo jurídico afirma que ambos devem ser separados e que as definições tanto do conceito quanto da validade do direito devem ser isentas de moral. Robert Alexy tenta mostrar que essa tese é incorreta. Existem conexões conceitualmente necessárias entre direito e moral e existem razões normativas para que as definições de direito e de validade do direito incluam elementos morais. Por isso, o positivismo jurídico fracassaria como teoria abrangente do direito. A análise termina com a proposta de uma definição do conceito de direito que reúne de forma sistemática os elementos da legalidade conforme o ordenamento, da eficácia social e da correção material.
