Law's Ideal Dimension provides a comprehensive account in English of renowned legal theorist Robert Alexy's understanding of jurisprudence, as expanded upon from his publications A Theory of Legal Argumentation (OUP 1989), A Theory of Constitutional Rights (OUP 1985), and The Argument fromInjustice (OUP 1992).The collection is divided into three parts. Part One concerns the nature of law: it explores its real and ideal dimensions and how the ideal dimension of law is sometimes employed but does not play a systematically important role. Part Two discusses constitutional rights, human rights, andproportionality. It defends the construction of constitutional rights as principles against objections raised by the rule construction and elaborates on the nature of constitutional rights as well as the mathematical balancing of those rights. Part Three concerns the relation between argumentation, correctness, and law. The author concludes this volume with a biographical reflection.

This book is a collection of lecture notes for the LIASFMA Shanghai Summer School on 'One-dimensional Hyperbolic Conservation Laws and Their Applications' which was held during August 16 to August 27, 2015 at Shanghai Jiao Tong University, Shanghai, China. This summer school is one of the activities promoted by Sino-French International Associate Laboratory in Applied Mathematics (LIASFMA in short). LIASFMA was established jointly by eight institutions in China and France in 2014, which is aimed at providing a platform for some of the leading French and Chinese mathematicians to conduct in-depth researches, extensive exchanges, and student training in the field of applied mathematics. This summer school has the privilege of being the first summer school of the newly established LIASFMA, which makes it significant.

Understood one way, the branch of contemporary philosophical ethics that goes by the label "metaethics" concerns certain second-order questions about ethics-questions not in ethics, but rather ones about our thought and talk about ethics, and how the ethical facts (insofar as there are any) fit into reality. Analogously, the branch of contemporary philosophy of law that is often called "general jurisprudence" deals with certain second order questions about law- questions not in the law, but rather ones about our thought and talk about the law, and how legal facts (insofar as there are any) fit into reality. Put more roughly (and using an alternative spatial metaphor), metaethics concerns a range of foundational questions about ethics, whereas general jurisprudence concerns analogous questions about law. As these characterizations suggest, the two sub-disciplines have much in common, and could be thought to run parallel to each other. Yet, the connections between the two are currently mostly ignored by philosophers, or at least under-scrutinized. The new essays collected in this book are aimed at changing this state of affairs. Dimensions of Normativity collects together works by metaethicists and legal philosophers that address a number of issues that are of common interest, with the goal of accomplishing a new rapprochement between the two sub-disciplines.

From Transnational Relations To Transnational Laws written by Professor Anne Griffiths and has been published by Ashgate Publishing, Ltd. this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-02-28 with Law categories.

This book approaches law as a process embedded in transnational personal, religious, communicative and economic relationships that mediate between international, national and local practices, norms and values. It uses the concept "living law" to describe the multiplicity of norms manifest in transnational moral, social or economic practices that transgress the territorial and legal boundaries of the nation-state. Focusing on transnational legal encounters located in family life, diasporic religious institutions and media events in countries like Norway, Sweden, Britain and Scotland, it demonstrates the multiple challenges that accelerated mobility and increased cultural and normative diversity is posing for Northern European law. For in this part of the world, as elsewhere, national law is challenged by a mixture of expanding human rights obligations and unprecedented cultural and normative pluralism enhanced by expanding global communication and market relations. As a consequence, transnationalization of law appears to create homogeneity, fragmentation and ambiguity, expanding space for some actors while silencing others. Through the lens of a variety of important contemporary subjects, the authors thus engage with the nature of power and how it is accommodated, ignored or resisted by various actors when transnational practices encounter national and local law.

Law S Claim To Correctness written by Maria Claudia Quimbayo Duarte and has been published by Nomos Verlag this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-11-19 with Law categories.

The book describes the main concepts of the correctness thesis. The second part presents a reconstruction of the claim to correctness in some classical legal theories. For instance, it explains the thesis that we can find two different references to claims in Kelsen ́s theory, therefore allusions to a kind of classifying and qualifying connections. About Fuller one can find the idea that he introduces not only a procedural moral claim but also a substantive one. With respect to Radbruch, the book holds the idea that the correctness thesis can be found in his theory since 1932. The third part considers some main objections against the claim to correctness especially that proposed by Joseph Raz and John Finnis among others.

Dimensions Of Teaching Business Ethics In Asia written by Stephan Rothlin and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-04-15 with Business & Economics categories.

A growing number of higher education institutions in Asia are now integrating ethics courses in their curricula. But the challenge remains to develop courses that can effectively reach their objectives, and to create and use teaching materials appropriate to the particular profile of the students and executives in different regions and cultures. In this context, enhancing awareness for ethical dilemmas, proposing frameworks and models to help managers handle difficult choices and demanding decisions - while not being moralistic and imposing values - , and presenting alternative approaches through recent and relevant cases are the main objectives of this book. It examines teaching methods, learning tools and pedagogical methods effective in the teaching of ethics within the particular context of the rich diversity of Asian cultures, and discusses ethics courses curricula, aiming at developing the capacity to deal with a number of issues such as corruption, intellectual property protection, whistle blowing and consumer rights. The relevance and limits of Asian philosophical and spiritual traditions and how their underlying values can be a meaningful aspect in the teaching of ethics to managers and business leaders are explored, as are the benefits and limits of corporate codes of conduct and ways to enhance their effectiveness. A similar approach is taken to the introduction of “oaths” and “ethics pledges” among business students, which has been promoted in some business schools.

Finite Physical Dimensions Optimal Thermodynamics 1 written by Michel Feidt and has been published by Elsevier this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-08-28 with Science categories.

Energy and the environment are inextricably linked to the economy. Thermodynamics therefore seems to be a privileged tool in overcoming the constraints associated with optimization. This first volume reports on an original, contemporary approach leading to optimal solutions in the form of trend models, proving the existence of solutions which can then be refined in a more complete and sophisticated manner. The validation of the proposed methodology is realized through real-life examples (engines, heat pumps, refrigeration systems, etc.). However, the more fundamental aspects linked to the dynamics of the transfer and conversion of energy and matter are also explored, as well as the evolution which characterizes the second law of thermodynamics. This book presents recent advances, often still undergoing research, as well as structured exercises, and is therefore aimed at both students and researchers in the field of energetics. It proposes a view of the evolution of knowledge regarding the thermodynamics modeling of systems and processes It shows results and also the existence of optimum all and along the development It focuses on multidisciplinary approach that characterizes thermodynamics
