This book critically evaluates the current copyright law system in a digital environment from a comparative perspective. Since many developing countries modelled their copyright laws on more advanced jurisdictions, they have not benefitted from such a law as much as intended due to their inherently embedded social economic conditions. Moreover, the copyright law system has been under constant challenges from rapidly developing digital technology and the Internet. All in all, there is a pressing need for developing countries to reevaluate their copyright law in light of their national needs, the developmental stage of their economy, their culture and tradition, and their legal system. The book poses the question of whether copyright law should be reformed to fulfill its fundamental purpose of serving education and research that are in the public interest in the digital era? It examines whether the legal frameworks adequately address developing countries’ educational and research requirements in view of the opportunities and restrictions posed by electronic communication media. Further, it provides a comprehensive study that addresses the various critical issues relevant to the reform of the copyright law system and offers recommendations for developing countries to revamp their copyright law system to better serve their education and research sector.

Protection for intellectual property has never been absolute; it has always been limited in the public interest. The benefits of intellectual property protection are meant to flow to everyone, not just a limited population of creators and the corporations that represent them. Given this social-utility function, intellectual property regimes must address issues of access, inclusion, and empowerment for marginalized and excluded groups. This handbook defines an approach to considering social justice in intellectual property law and regulation. Top scholars in the field offer surveys of social justice implementation in patents, copyright, trademarks, trade secrets, rights of publicity, and other major IP areas. Chapters define Intellectual Property Social Justice theory and include recommendations for reforming aspects of IP law and administration to further social justice by providing better access, more inclusion, and greater empowerment to marginalized groups.

Asia Redux written by Prasenjit Duara and has been published by Institute of Southeast Asian Studies this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-06-27 with History categories.

"In the erudite essay that opens this forum, Prasenjit Duara turns to both indigenous thinkers and the premodern past for tools with which to think about Asia in a global age. Contemporary modalities of regional exchange – ‘weakly bounded, network-oriented, pluralistic, multitemporal’ – chime with earlier patterns of cultural circulation without state domination, giving rise to a prophetic vision of ‘Asia Redux’. This attempt to capture the contours of a (re)-emergent region was calculated to provide. And what a debate it kicks off. Wang Hui resolutely reframe imagining Asia as a political project on a world-historical canvas. Tansen Sen greatly complicates the map of intra-Asian commercial exchange in earlier times; Amitav Acharya outlines five competing conceptions of Asia in the domain of international relations alone.; Barbara Watson Andaya teases out the paradoxical way in which regional religions make clashing claims about Asian unity; and Rudolf Mrazek asks, what of the Asia that bleeds? what of exploitation and its spawn, the inglorious ‘built-ends’ of the global economy? The reward for those who read this collection straight through is a thrillingly cacophonous conversation about how to grasp Asia in our time.” —Karen E. Wigen, Stanford University “Will a re-emergent Asia extend the violent rivalries and inequalities of Western-dominated empires, nations and capital? Or can Asia somehow draw on a relatively more peaceful past of maritime trade, interlinked religions and circulations beyond states to think and make a very different sort of region and world? Prasenjit Duara and his interlocutors define this vital debate on Asia’s future through illuminating reflections on its recent and deep past. A touchstone for anyone concerned with a future shape of an inter-connected Asia newly possessed of wealth and power” —Engseng Ho, Duke University

Maritime Spatial Planning written by Jacek Zaucha and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-01-01 with Environmental Law/Policy/Ecojustice categories.

This book is open access under a CC BY 4.0 license Maritime or marine spatial planning has gained increasing prominence as an integrated, common-sense approach to promoting sustainable maritime development. A growing number of countries are engaged in preparing and implementing maritime spatial plans: however, questions are emerging from the growing body of MSP experience. How can maritime spatial planning deal with a complex and dynamic environment such as the sea? How can MSP be embedded in multiple levels of governance across regional and national borders – and how far does the environment benefit from this new approach? This open access book is the first comprehensive overview of maritime spatial planning. Situated at the intersection between theory and practice, the volume draws together several strands of interdisciplinary research, reflecting on the history of MSP as well as examining current practice and looking towards the future. The authors and contributors examine MSP from disciplines as diverse as geography, urban planning, political science, natural science, sociology and education; reflecting the growing critical engagement with MSP in many academic fields. This innovative and pioneering volume will be of interest and value to students and scholars of maritime spatial planning, as well as planners and practitioners. Jacek Zaucha is Professor of Economics at Gdánsk University, Poland. He is long experienced in maritime spatial planning, and is currently leading the team preparing the first plan for Polish waters. Kira Gee is Research Associate at the Centre for Materials and Coastal Research (Helmholtz-Zentrum Geesthacht), Germany. She has been involved in MSP research and practice for over 20 years, and has participated in numerous national and transnational European MSP projects.

The first of its kind, this book presents a comprehensive collection of leading patent cases from nine major Asian jurisdictions which are analyzed by eminent scholars and legal practitioners from Asia, Germany, and the United States. It contains thirty case reports covering six topics which best reflect the current trends in Asia in patent law, namely specialized IP court (or division), compulsory licensing, the intersection between patent law and competition law, injunction, damages, and choice of jurisdiction and law in cross-border patent litigation. Each case report explores a landmark case by deconstructing the legal background and the legal reasoning of the decisions, and then discussing the commercial and/or industrial ramifications. The present volume is a useful guide for practitioners, lawyers, and judges alike, a primer for students and businessmen entering the IP world, and a reminder for policymakers, both within Asia and further afield.

This comprehensive text provides the latest research on key concepts, principles and practices for promoting healthy and sustainable food systems. There are increasing concerns about the impact of food systems on environmental sustainability and, in turn, the impact of environmental sustainability on the capacity of food systems to protect food and nutrition security into the future. The contributors to this book are leading researchers in the causes of and solutions to these challenges. As international experts in their fields, they provide in-depth analyses of the issues and evidence-informed recommendations for future policies and practices. Starting with an overview of ideas about health, sustainability and equity in relation to food systems, Healthy and Sustainable Food Systems examines what constitutes a food system, with chapters on production, manufacturing, distribution and retail, among others. The text explores health and sustainable diets, looking at issues such as overconsumption and waste. The book ends with discussions about the politics, policy, personal behaviours and advocacy behind creating healthy and sustainable food systems. With a food systems approach to health and sustainability identified as a priority area for public health, this text introduces core knowledge for students, academics, practitioners and policy-makers from a range of disciplines including food and nutrition sciences, dietetics, public health, public policy, medicine, health science and environmental science.
