Un Human Rights Institutions And The Environment written by Sumudu Atapattu and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-05-22 with Political Science categories.

This book presents an in-depth analysis of how UN human rights institutions and mechanisms have addressed environmental protection, sustainable development, and climate change. Despite the increasing involvement of UN human rights bodies in addressing environmental degradation and climate change, a systematic review of the convergence between human rights and the environment in these bodies has not been carried out. Filing this lacuna, this book surveys the resolutions, general comments, concluding observations, decisions on individual communications and press releases. It identifies principles that have emerged, explores the ways in which human rights charter-based and treaty-based institutions are interpreting environmental principles and examines how they contribute to the emerging field of human rights and the environment. Given the disproportionate effect that polluting activities have on marginalized and vulnerable groups, Atapattu also discusses how these human rights mechanisms have addressed the impact on women, children, indigenous peoples, people with disabilities, and racial minorities. Written by a world-renowned expert on human rights and the environment, this book will be of great interest to students and scholars researching and teaching in this important field of study.

The Domestic Institutionalisation Of Human Rights written by Stéphanie Lagoutte and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-08-19 with Political Science categories.

This book explores recent developments pointing towards a ‘domestic institutionalisation of human rights’, composed of converging international trends prescribing the setting up of domestic institutions, and the need for a national human rights systems approach. Building on new compliance theories, innovative arrangements have resolutely appeared around the turn of the millennium and some are now legally enshrined in human rights treaties. In their introduction, the editors capture these developments, their main elements and key points of debate. They outline a research agenda aimed at structuring and generating further attention from both academics and practitioners. As a stepping stone, the book singles out the purposeful attempt by the United Nations and others to frame these trends around the concept of ‘National Human Rights System’. The chapters assess various models and cases put forward for such systems. Each chapter highlights the specific forms of institutions being promoted and their intended domestic interactions, and discusses how these institutions are leveraged and strengthened by international bodies. Authors critically review their implications for the future of human rights, paving the way for additional research. The chapters in this book were originally published as a special issue of the Nordic Journal of Human Rights.

This book explores the human rights principle of participation and the human right to participation. The work presents an argument that international human rights law imposes obligations to enable participation, and demonstrates that it has been interpreted in this way by authoritative bodies. Divided into four parts, Part I provides the historical and theoretical background. Part II presents the argument that a right to participation and a human rights principle of participation exist in international law and Part III argues that human rights law, and the way it has been interpreted, can provide a coherent account of the content of such a right and principle. The conclusions of the book and their implications are explored in Part IV. While there have been several studies of specific forms of participation, such as collective bargaining, this study provides a coherent account of the meaning and application of participation in international human rights law as a whole. The book will be an invaluable resource for academics, researchers, and policy-makers working in the area of international human rights law.

The development of an international human rights jurisprudence on criminalization is in its relative infancy. Nonetheless, systematic examination of international decisions on acts engaging the criminal law reveals an emerging human rights approach to the acceptability, or not, of criminalization. This book provides an in-depth characterization of the reasoning and principles that underpin those decisions. The work builds upon and adds value to existing literature by bringing together two fields of study – international human rights law and criminal theory – that usually receive separate treatment. It provides an in-depth analysis of human rights criminalization jurisprudence and presents a systematic identification of underlying reasoning and concepts that influence international human rights decisions on criminalization. The work thus advances both fields independently, as well as providing an example of inter-(sub)disciplinary analysis. The book will be a valuable resource for academics and students working in the areas of International Human Rights Law, Criminal Law, and Moral Philosophy.

This book deals with the problem of human trafficking in Tanzania in the light of international law and considers human trafficking as both a criminal offence in Tanzania and a human rights violation within international law in general. The book broadens the reader's understanding of the subject of human trafficking and Tanzania's legal approach to the issue and allows the reader to grasp Tanzania's anti-trafficking piecemeal efforts from the 1970s onwards, the reasons that made Tanzania ratify the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime, and Tanzania's National Assembly's deliberations regarding the enactment of the Anti-Trafficking in Persons Act of 2008 and the impact those deliberations have had on the current legal framework of Tanzania. It provides a firsthand critical analysis of the Tanzania anti-trafficking law, pointing out its strengths, weaknesses and areas for improvement in a comprehensive manner such as has never been attempted before. The book shares many tips and even insights on how to read and apply Tanzania's 2015 Anti-Trafficking Regulations in relation to the main law harmoniously. It also offers complete instructions for common-law practitioners, court personnel, researchers and other anti-trafficking personnel on how to investigate and prosecute human trafficking, prevent trafficking, both lawfully and from occurring, as well as assist victims of human trafficking and protect their human rights. Nicksoni Filbert Kahimba is a doctoral researcher in the Faculty of Law of the Humboldt Universität zu Berlin in Berlin, Germany.

The International Convention on the Elimination of All Forms of Racial Discrimination was adopted thirty-five years ago, on 21 December 1965, by the General Assembly of the United Nations, and entered into force on 4 January 1969. It was the first of the universal human rights treaties with a treaty-monitoring body to be adopted and enter into force. At present, 156 States have ratified or acceded to this Convention. Under article 9 of the Convention, each State party has to submit a report within one year after the entry into force of the Convention for that State and thereafter every two years and whenever so requested. The Committee on the Elimination of Racial Discrimination has been formed to monitor the implementation of the Convention. At its fortieth session, in 1991, the Committee initiated the practice of adopting concluding observations by the Committee as a whole on each report it considered, and at its forty-third session, in 1993, the Committee started to use a standard format for the presentation of its concluding observations. The Committee makes a general evaluation of the report and of the dialogue with the delegation, and it makes note of positive developments that may have occurred during the period under review, of factors and difficulties impeding the implementation of the Convention, and of principal subjects of concern. It also makes suggestions and recommendations to the State party concerned. The present volume contains concluding observations adopted by the Committee on the Elimination of Racial Discrimination at its forty-third to fifty-seventh sessions (1993-2000). Foreword by Mrs. Mary Robinson, United Nations High Commissioner for Human Rights.
