Excerpt from Concordancias y Fundamentos del Codigo Civil Argentino, Vol. 9 Frances, al tratar de las obligaciones ponen la inscripcion De los contratos 6 de las obligaciones convencionales, equivocando los contratos con las obligaciones, lo que causa una inmensa confusion en la jurisprudencia, y produce errores que no pueden correjirse Zacharia, al llegar esta parte del Codigo Frances, dice asi N ada mas vicioso que el metodo seguido por los redactores del Codigo. Hay cinco fuentes de las bligaciones: Los contratos 6 con venciones, 29 los casi contratos, los delitos, los cuasi delitos y la ley. Era evidente que para proceder con orden, debieron abrazar en un solo titulo todas las obligaciones en general; pero los redactores del Codigo, al contrario, han comenzado por dividir la materia de las obligaciones en general, en dos titulos: el uno de las obligaciones convencionales, y el otro de las obligaciones que se forman sin convencion; y como para disimular la unidad natural de la materia que sometian a esta division logica, han afectado reservar el nombre de obligacion para las que resultan de los contratos, dando a las otras el nombre de mgayemcnt, como si no fuesen palabras sinonimas. Este primer vicio que causa una mezcla de las ideas mas incoherentes, nace de haber olvidado que una cosa es el contrato que da nacimiento 6 la obligacion y otra la obligacion convencional, que no es sino el efecto del contrato.
