Homophobia exists in many different forms across Europe. Member States offer uneven levels of legal protection for lesbian and gay rights; at the same time the social meanings and practices relating to homosexuality are culturally distinct and intersect in complex ways with gender, class and ethnicity in different national contexts. The essays in this volume illustrate the findings of a European project on homophobia and fundamental rights in which sociologists and legal experts have analysed the position in four Member States: Italy, Slovenia, Hungary and the UK. The first part of the book investigates the sociological dimensions of homophobia through qualitative methods involving both heterosexual and self-defined lesbian and gay respondents, including those in ethnic communities. The aim is to understand how homophobia and homosexuality are defined and experienced in the everyday life of participants. The second part is devoted to a legal analysis of how homophobia is reproduced 'in law' and how it is confronted 'with law'. The analysis examines statute and case law; 'soft law'; administrative practices; the discussion of bills within parliamentary committees; and decisions of public authorities. Among the areas discussed are 'hate crimes' and 'hate speech'; education at all levels; free movement, immigration and asylum; and cross-border reproductive services. Organisations representing lesbian, gay, bisexual and transgender (LGBT) persons have been denied registration or banned from organising peaceful meetings in some states in Europe. Too few politicians have taken a firm stand against homophobic and transphobic expressions, discrimination and violence.This report presents the results of the largest socio-legal study ever carried out on discrimination on grounds of sexual orientation and gender identity in the 47 member states of the Council of Europe. Six thematic chapters give a broad overview of the human rights situation of LGBT persons and recommendations are provided for developing and implementing effective measures to address discrimination.The report is intended as a tool for dialogue with authorities and other stakeholders. It constitutes a baseline study for further action in both legislative and policy fields to ensure that all LGBT people can effectively exercise their human rights.

This volume addresses three things many people do not discuss candidly with strangers or mere acquaintances: God, sex, and politics. These can easily become topics of fierce debate, particularly when taken together, as has been the case with same-sex marriage legislation, the Vatican’s criticism of “gender ideology,” or the repeatedly asserted claim that Islam, homosexuality, and gender equality are essentially incompatible. This volume investigates what is at stake in these constructions of religion and homosexuality in public discourses. Starting with the Netherlands as a special case study, it proceeds with contributions on other predominantly postsecular countries in central, northern, and southern Europe as well as several postcommunist and postcolonial countries “beyond Europe.” Combining contemporary and historical perspectives and approaches from both the humanities and the social sciences, the contributors explore how national and European identities are constructed and contested in debates on religion and homosexuality. Why Europe Is Lesbian and Gay Friendly (and Why America Never Will Be) examines the differences in politics, policy, and culture in leading Western democracies and offers an explanation as to why lesbian and gay citizens in Europe reap more benefits of equality. This analysis of the political economy of care calls attention to the ways in which care is negotiated by various investors (the state, families, individuals, and the faith-based voluntary sector) and the power dynamics of this negotiation. Historically, Christian churches have been leading primary investors in care, providing a direct safety net for children and the elderly. Despite European secularization, the involvement of the Christian church elites in both the provision of service and the setting of the values frame for welfare cannot be underestimated. The historical involvement of Christian churches is unique in each country, but one common factor is the normative interpretation of "the family." The role of Christian values—from left-leaning social justice, Reformed Protestant individualism, or social conservatism—in relation to the political economy of care gives a distinctive flavor to questions about under what circumstances policymakers are compelled, or not, to expand policies to include lesbian and gay citizens.
