This report examines the historical development and contemporary role of congressional Member organizations (CMOs) in the House and informal Member groups in both the House and the Senate. It discusses the differences between CMOs (which register with the Committee on House Administration) and informal Member groups (which do not register with the Committee on House Administration) and the reasons Members form these groups (often referred to as caucuses). The report also presents the rise and fall of legislative service organizations (LSOs), the House's decision in 1995 to issue regulations for establishing CMOs and governing their behavior, and the subsequent regulation of CMOs in the House by the Committee on House Oversight/Committee on House Administration. It provides a step-by-step guide for House Members and staff who might be interested in forming a CMO. Many of the steps in the guide may be of interest to Senators and their staff who are considering forming an informal Member group in the Senate. CMOs exist to affect public policy, either directly through policy advocacy for a region or an issue, or indirectly by attracting media attention, or through the socialization and orientation of their Members. Nearly all CMOs serve as forums for the exchange of information. Many hold regular Member or staff meetings, typically weekly, monthly, or quarterly depending on the legislative calendar, to exchange information and develop legislative strategy. Many CMOs also invite outside speakers and groups to make presentations to the CMO's members. There are seven types of CMOs: (1) intraparty CMOs promote the policy views of like-minded Members within a political party; (2) personal interest CMOs (the most prevalent type) typically focus on a broad, single concern, such as the environment or children, that is often under the jurisdiction of more than one committee; (3) industry CMOs advocate the interests of a particular industry; (4) regional CMOs champion the interests of a particular region; (5) state/district CMOs advocate the interests of a particular state or district; (6) national constituency CMOs advocate the interests of particular constituencies, such as women, minorities, and veterans; and (7) diplomacy CMOs concern themselves with improving foreign relations with another country or region of the world. In recent years, the number of CMOs and informal Member organizations has increased, more than doubling from the 108th Congress (350) to the 113th Congress (739). This increase has taken place even though House Members can no longer provide CMOs and informal Member groups congressional office space; use the congressional frank or lend them money to support their activities; use their Member Representational Allowance to directly support them as an independent entity; or accept goods, funds, or services from private organizations or individuals to support their activities. Despite the limitations imposed on the options available to House Members to support informal Member organizations, CMOs and, to a somewhat lesser extent given their ad-hoc nature, informal Member groups, have retained an important role in the congressional policymaking process. Their influence has endured largely because many Members continue to consider their participation in informal Member groups and CMOs as advantageous in achieving their primary goals of policy advocacy, reelection, and power within the institution.

The Congressional Research Service (CRS) developed the Congressional Oversight Manual over 30 years ago, following a three-day December 1978 Workshop on Congressional Oversight and Investigations. The workshop was organized by a group of House and Senate committee aides from both parties and CRS at the request of the bipartisan House leadership. The Manual was produced by CRS with the assistance of a number of House committee staffers. In subsequent years, CRS has sponsored and conducted various oversight seminars for House and Senate staff and updated the Manual as circumstances warranted. Worth noting is the bipartisan recommendation of the House members of the 1993 Joint Committee on the Organization of Congress (Rept. No. 103-413, Vol. I): [A]s a way to further enhance the oversight work of Congress, the Joint Committee would encourage the Congressional Research Service to conduct on a regular basis, as it has done in the past, oversight seminars for Members and congressional staff and to update on a regular basis its Congressional Oversight Manual. Over the years, CRS has assisted many Members, committees, party leaders, and staff aides in the performance of the oversight function: the review, monitoring, and supervision of the implementation of public policy. Understandably, given the size, reach, cost, and continuing growth of the modern executive establishment, Congress's oversight role is even more significant-and more demanding-than when Woodrow Wilson wrote in his classic Congressional Government (1885): "Quite as important as lawmaking is vigilant oversight of administration." Today's lawmakers and congressional aides, as well as commentators and scholars, recognize that Congress's work, ideally, should not end when it passes legislation. Oversight is an integral way to make sure that the laws work and are being administered in an effective, efficient, and economical manner. In light of this destination, oversight can be viewed as one of Congress's principal responsibilities as it grapples with the complexities of the 21st century.

The National Institute of Standards and Technology (NIST), a laboratory of the Department of Commerce, is mandated to provide technical services to facilitate the competitiveness of U.S. industry. NIST is directed to offer support to the private sector for the development of precompetitive generic technologies and the diffusion of government-developed innovation to users in all segments of the American economy. Laboratory research is to provide measurement, calibration, and quality assurance techniques that underpin U.S. commerce, technological progress, improved product reliability, manufacturing processes, and public safety. Concerns about the adequacy of federal funding for physical science and engineering research led to efforts by President George W. Bush (under his American Competitiveness Initiative and annual budget requests), President Obama (in his annual budget requests), and Congress (implicitly in appropriations authorizations in the America COMPETES Act and the America COMPETES Reauthorization Act of 2010) to double funding for the NIST laboratory and construction accounts, together with the National Science Foundation and the Department of Energy Office of Science. However, appropriations did not keep pace with authorization levels or presidential requests. In addition, the appropriations authorizations for the accounts targeted for doubling have lapsed and President Obama's budget requests have not referenced a specific doubling goal or timeframe since his FY2013 request. It remains to be seen how support for internal research and development at NIST will evolve and how this might affect financing of extramural efforts. Continued funding for NIST extramural programs directed toward increased private sector commercialization has been a topic of congressional debate. Some Members of Congress have expressed skepticism over a “technology policy” based on providing federal funds to industry for development of pre-competitive generic technologies. This approach, coupled with pressures to balance the federal budget, led to significant reductions in funding for NIST. The Advanced Technology Program (ATP) and the Manufacturing Extension Partnership (MEP), which accounted for over 50% of the FY1995 NIST budget, were proposed for elimination. In 2007, ATP was terminated and replaced by the Technology Innovation Program (TIP). TIP was subsequently eliminated in the FY2012 appropriations legislation. In December 2014, Congress enacted the Revitalize American Manufacturing and Innovation Act of 2014 as Title VII of Division B of the Consolidated and Further Continuing Appropriations Act, 2015 (P.L. 113-235), establishing a Network for Manufacturing Innovation (NMI). The NMI program is similar to the National Network for Manufacturing Innovation proposed by President Obama in his FY2013-FY2015 budgets. The act does not appropriate funds specifically for the NMI program but instead authorizes NIST to spend up to $5.0 million of funds appropriated to the laboratory's Industrial Technology Services account each year from FY2015 to FY2024 to carry out the program. In addition, the act authorizes the Department of Energy to transfer up to a total of $250.0 million to NIST between FY2015 and FY2024 to carry out the program. The act allows a number of existing manufacturing centers to be classified as centers for manufacturing innovation and eligible for participation in the network of centers. Many issues related to the establishment, operation, management, and funding of the NMI remain to be addressed.
