O livro explora a relação entre a ação efetiva dos Conselhos Gestores, como espaços de participação democrática, e as questões jurídicas da vinculação e da prioridade. Nesse contexto, busca suprir lacuna dos estudos e focar em instrumento político-jurídico, de extrema importância na consolidação democrática de nosso país, que são os conselhos. Nesse desiderato, a ação efetiva é compreendida como aquela que contempla a participação da sociedade civil nos debates, na proposição e na elaboração de decisões sobre políticas públicas municipais na área da criança e do adolescente e que busca os meios de fazer valer o teor do decidido junto ao Poder Público municipal. De um lado , a vinculação, por mandamento constitucional e legal, determina a inclusão, nos orçamentos públicos, das políticas públicas deliberadas nos âmbitos dos conselhos. De outro lado, também há previsão de atendimento prioritário às demandas da população infantojuvenil, que deve ser realizado pelas ações do Conselho, o que reflete na impositividade das deliberações. Entretanto a realidade dos Conselhos tem demonstrado que o Poder Público não tem convertido as deliberações em políticas públicas municipais, as quais, na seara da Infância e da Juventude, têm de ser prioritárias. Com base na análise das atas, no decorrer de duas gestões do Conselho Municipal dos Direitos da Criança e do Adolescente da cidade de Toledo/PR, especificamente as gestões 2007/2009 e 2009/ 2 011, c or robora-se a explicação, formulada como hipótese inicial, a esse descompasso, lastreada no comportamento do próprio Conselho: quanto mais efetiva for a ação do Conselho, mais o Poder Público acatará suas deliberações, incluindo-as no orçamento e transformando-as em políticas públicas.

Como se desenvolve a avaliação escolar de jovens presos para cumprimento de medida socioeducativa? Quais as implicações dessa prática para a conquista de aprendizagens que possibilitem aos socioeducandos interpretar o mundo e nele viver buscando torná-lo mais humano e solidário? Avaliação e socioeducação: desafios e perspectivas na escolarização de jovens em conflito com a lei discute questões como essas, contribuindo para o debate em torno da escolarização de jovens que se encontram em situação de privação de liberdade. Aspectos como o mau uso do tempo destinado ao trabalho desenvolvido junto aos socioeducandos, a preponderância da segurança sobre a educação e a desarticulação entre o trabalho escolar e o dos demais setores da Unidade de Internação são apontados na obra, como capazes de comprometer a avaliação e o trabalho pedagógico desenvolvidos em contextos de clausura. A influência da avaliação escolar sobre as decisões judiciais e dessas decisões sobre as avaliações desenvolvidas junto a estudantes reclusos por cometimento de ato infracional, indicam a existência, nesse contexto, de um quarto nível avaliativo, marcando o ineditismo da obra. Espaços-tempos coletivos que viabilizem formas dialógicas e democráticas de participação são apresentados como alternativas necessárias, não só para a articulação dos níveis em que a avaliação acontece, mas também para a instauração de uma política educacional intersetorial que possibilite pensar e desenvolver conjuntamente o processo ressocializador dos jovens internos, o que inclui rever o modo condescendente de avaliar, que extrai dessa prática o caráter classificatório, mas não o excludente.

The ratification of the Convention on the Rights of the Child (CRC) by a majority of the International Labor Organization's member states technically affirms that children are born with fundamental freedoms and the inherent rights of all human beings. This should mark the 21st century as a century of hope for those children whose fundamental rights are violated across the world. There is, however, widespread concern that in spite of some successes in enlisting broad-based societal commitments to safeguard children's rights, there exists neither a universal consensus on the meaning and very concept of "children's rights" nor sufficient reasons for us to be content with the current status of children's rights worldwide. The widening of the gap between expectations and achievements in the area of human rights raises a fundamental issue: how comfortably does our commitment to children's rights fit with our convictions about social justice? Violation of children's rights multiplies at an alarming rate - pointing to the wholesale failure of policies, programs, interventions, and conventions designed to curb them. On the positive side, however, the present trends in the debate and advocacy around children's rights have great potential not only for improving the status of children. Child-centered demands for distributive justice have a much greater potential in terms of the possibility of building an intercultural consensus as compared to similar demands by other social groups. The 11 articles in this volume of The Annals seek to address some of the dominant themes in the current debate over children's rights in order to facilitate new paradigms and directions that could be effective in responding to this most important issue. This issue of The Annals deals with the various topics crucial in the discussion of children's rights around the world.
