Montesquieu's Considerations on the Causes of the Greatness of the Romans and Their Decline was published almost midway between his Persian Letters (1721) and The Spirit of the Laws (1748). Today it is the least well known of the three, though not through any fault of its own. It may have been the first (and certainly was one of the first) of all efforts to comprehend the whole span of Roman history, and among such efforts it still has few if any peers -- even after a century and a half of the scientific historiography Montesquieu's own writings did so much to engender, and which has now grown disdainful of its philosophic forbears. It was probably one of the works Gibbon had in mind in his Memoirs when he wrote: " ... but my delight was in the frequent perusal of Montesquieu, whose energy of style, and boldness of hypothesis, were powerful to awaken and stimulate the genius of the age." But the context in which it must be understood, and from which it derives its chief value, is not that of history but of political philosophy. In the annals of this subject, it is one of the few instances when a philosopher has undertaken an extended analysis of any particular society, let alone of its entire history. The only comparable thing on Rome is Machiavelli's Discourses, to which it bears a deep inner kinship. But it is simpler than the Discourses, both in structure and meaning. For the most part it uses an historical framework, beginning with Rome's origins and ending with its collapse, and its teaching is in some ways less devious. - Introduction.

Charles-Louis de Secondat, Baron de La Brede et de Montesquieu generally referred to as simply Montesquieu, was a French lawyer, man of letters, and political philosopher who lived during the Age of Enlightenment. He is famous for his articulation of the theory of separation of powers, which is implemented in many constitutions throughout the world. He did more than any other author to secure the place of the word despotism in the political lexicon. Montesquieu is credited as being among the progenitors, which include Herodotus and Tacitus, of anthropology, as being among the first to extend comparative methods of classification to the political forms in human societies. Indeed, the French political anthropologist Georges Balandier considered Montesquieu to be "the initiator of a scientific enterprise that for a time performed the role of cultural and social anthropology." According to social anthropologist D. F. Pocock, Montesquieu's The Spirit of the Laws was "the first consistent attempt to survey the varieties of human society, to classify and compare them and, within society, to study the inter-functioning of institutions." Montesquieu's political anthropology gave rise to his theories on government. When Catherine the Great wrote her Nakaz (Instruction) for the Legislative Assembly she had created to clarify the existing Russian law code, she avowed borrowing heavily from Montesquieu's Spirit of the Laws, although she discarded or altered portions that did not support Russia's absolutist bureaucratic monarchy."

The Constitution of the United States divides war powers between the executive and legislative branches to guard against ill-advised or unnecessary military action. This division of powers compels both branches to hold each other accountable and work in tandem. And yet, since the Cold War, congressional ambition has waned on this front. Even when Congress does provide initial authorization for larger operations, they do not provide strict parameters or clear end dates. As a result, one president after another has initiated and carried out poorly developed and poorly executed military policy. The Politics of War Powers offers a measured, deeply informed look at how the American constitutional system broke down, how it impacts decision-making today, and how we might find our way out of this unhealthy power division. Sarah Burns starts with a nuanced account of the theoretical and historical development of war powers in the United States. Where discussions of presidential power often lean on the concept of the Lockean Prerogative, Burns locates a more constructive source in Montesquieu. Unlike Locke, Montesquieu combines universal normative prescriptions with an emphasis on tailoring the structure to the unique needs of a society. In doing so, the separation of powers can be customized while maintaining the moderation needed to create a healthy institutional balance. He demonstrates the importance of forcing the branches into dialogue, putting them, as he says, “in a position to resist” each other. Burns’s conclusion—after tracing changes through Franklin Delano Roosevelt’s administration, the Cold War, and the War on Terror—is that presidents now command a dangerous degree of unilateral power. Burns’s work ranges across Montesquieu’s theory, the debate over the creation of the Constitution, historical precedent, and the current crisis. Through her analysis, both a fuller picture of the alterations to the constitutional system and ideas on how to address the resulting imbalance of power emerge.

This volume makes available in an English translation the most significant part of Montesquieu's political, social and legal theory. About two-thirds of the volume has been translated from the Spirit of the Laws, not redone in English since the eighteenth century. That version was notoriously inadequate: Montesquieu's key terms were not rendered consistently; often his meaning was distorted by giving the nearest English eighteenth-century legal or institutional equivalent. Finally, English usage has changed so much that the eighteenth-century translation makes Montesquieu seem both quaint and obscure. This volume also includes substantial selections from the Persian Letters and the Considerations on the Causes of the Romans; Greatness and Decline. Although adequate translations of these works exist, it seemed advisable to maintain intellectual and stylistic consistency by providing English versions on the same principles as the Spirit of the Laws.
