Freedom of information is a principle commonly associated with the United States’ First Amendment traditions or digital-era technology boosters. Barriers Down reveals its unexpected origins in political, economic, and cultural battles over analog media in the mid-twentieth century. Diana Lemberg traces how the United States shaped media around the world after 1945 under the banner of the “free flow of information,” showing how the push for global media access acted as a vehicle for American power. Barriers Down considers debates over civil liberties and censorship in Nazi Germany, the Soviet Union, and elsewhere alongside Americans’ efforts to circumvent foreign regulatory systems in the quest to expand markets and bring their ideas to new publics. Lemberg shows how in the decades following the Second World War American free-flow policies reshaped the world’s information landscape, though not always as intended. Through burgeoning information diplomacy and development aid, Washington diffused new media ranging from television and satellite broadcasting to global English. But these actions also spurred overseas actors to articulate alternative understandings of information freedom and of how information flows might be regulated. Bridging the historiographies of the United States in the world, human rights, decolonization and development, and media and technology, Barriers Down excavates the analog roots of digital-age debates over the politics and ethics of transnational information flows.

This book is a direct result of the publication of the 1994 Netherlands Yearbook of International Law, published in 1995. It was decided that the publication of the 25th Yearbook should be marked by a special volume written by current and former members of the Board of Editors, omitting the usual documentation sections. The central theme of this special volume is whether the secondary rules form a potential risk, constituting a threat to the global unity and efficacy of the international legal order. As many fields of international law as possible have been included: diplomatic law, the law of war, human rights, environmental law, and the law of international organizations (e.g. GATT/WTO and the European Communities). Este trabajo está dividido en cuatro partes bien diferenciadas. En la primera, denominada Normativa general sobre el estatuto jurídico del astronauta. Conceptualización de la voz «astronauta», se analiza pormenorizadamente las referencias a la figura del astronauta que encontramos en las Resoluciones, Tratados y Convenios de las Naciones Unidas. De igual modo, se analiza, desde un punto de vista jurídico, el lenguaje utilizado en dichos documentos. En la segunda parte, denominada La Estación Espacial Internacional. La tripulación en el seno de las actividades espaciales de carácter intergubernamental, analizamos los documentos que establecen las normas de convivencia a bordo de la Estación, en tanto que régimen legal de los residentes en la misma. La tercera parte, denominada Especificidades relativas a los astronautas. Los astronautas en el seno de sus organizaciones y agencias analizamos los requisitos iniciales, fases de entrenamiento y estatuto interno de los cuerpos de astronautas de cuatro de las potencias en materia espacial, esto es los Estados Unidos, los países europeos asociados a través de la Agencia Espacial Europea, China y la extinta Unión Soviética, hoy la Federación rusa. Del mismo modo, se estudia la evolución de las actividades espaciales de estas cuatro potencias y las líneas y objetivos de sus políticas espaciales como marco idóneo para la regulación de los astronautas. La cuarta parte, denominada El turismo espacial. Régimen jurídico de los participantes en un vuelo espacial, está dividida en varios apartados, estando el primero de ellos dedicado a dar una solución interpretativa a la ausencia de regulación específica para la figura del astronauta y del turista espacial. El segundo de los apartados está dedicado a analizar las normas internas de los Estados Unidos en relación a los participantes de un vuelo espacial. El tercero y último apartado analiza la posibilidad de utilizar otras ramas del Derecho internacional como base inspiradora para la regulación de aspectos civiles de un vuelo espacial que actualmente se encuentran sin cobertura legal. Este trabajo finaliza con unas Conclusiones finales que se presentan como una síntesis general de los análisis realizados y una específica toma de posición sobre los aspectos más relevantes que este trabajo de investigación ha puesto de manifiesto. Este estudio ha sido realizado desde una estricta perspectiva jurídica y con la intención de dotarlo del carácter innovador que el naciente Derecho de espacio ultraterrestre posee. Constituye el inicio de mi carrera investigadora y he trabajado con la voluntad de llevar al lector a reflexionar sobre la necesidad de llegar a un acuerdo de carácter internacional por el que se colmen las lagunas legales que se analizan y se regulen aquellos aspectos de gran importancia para el desarrollo de estas nuevas formas de utilización del espacio ultraterrestre, con el objetivo de dotar al ser humano de la mayor seguridad jurídica posible ante el inicio de actividades, que en la actualidad, entrañan aún un gran riesgo.
