This book addresses one central question: if justice is to be done in the name of the community, how far do the decision-makers need to reflect the community, either in their profile or in the opinions they espouse? Each contributor provides an answer on the basis of a careful analysis of the rules, assumptions and practices relating to their own national judicial system and legal culture. Written by national experts, the essays illustrate a variety of institutional designs towards a better reflection of the community. The involvement of lay people is often most visible in judicial appointments at senior court level, with political representatives sometimes appointing judges. They consider the lay involvement in the judicial system more widely, from the role of juries to the role of specialist lay judges and lay assessors in lower courts and tribunals. This lay input into judicial appointments is explored in light of the principle of judicial independence. The contributors also critically discuss the extent to which judicial action is legitimised by any ‘democratic pedigree’ of the judges or their decisions. This book explores secession from three normative disciplines: political philosophy, international law and constitutional law. The author first develops a moral theory of secession based on a hypothetical multinational contract. Under this contract theory, injustices do not determine the existence of a right to secede, but the requirements to exercise it. The book’s second part then argues that international law is more inclined to accept and advance a remedial right approach to secession. Therefore, justice as multinational fairness is to be fully institutionalized under the constitutional law of liberal democracies. The final part proposes constitutionalizing a qualified right to secede with the aim of fostering recognition and accommodation of national pluralism as well as cooperation and compromise between majority and minority nations.

El pensamiento de Juan Jaramillo gira alrededor del derecho constitucional. Pero la perspectiva con la cual abordaba este tema no era disciplinaria, sino abierta a todos los saberes sociales, sobre todo a la historia, a la sociología y a la ciencia política. Su obra no se reduce a las relaciones que el derecho constitucional mantiene con cada uno de estos tres ámbitos. Por el contrario, en sus textos se aprecia un interés marcado por comprender las Constituciones en toda su complejidad, desde un enfoque social, histórico y político, bajo el entendido de que ninguno de estos podía dar suficientes luces sin tener en cuenta sus relaciones con los demás. El carácter interdisciplinario de la obra de Juan Jaramillo se constata igualmente por el hecho de abordar diversos tipos de cuestiones. Sus trabajos pueden ser clasificados alrededor de tres temas centrales, ente los cuales existen múltiples relaciones: i) el estudio de la Constitución colombiana, pero situándola en su contexto histórico, ii) el análisis de los sistemas electorales comparados, con énfasis en el caso colombiano; y iii) el análisis de la justicia constitucional y su relación con derechos fundamentales.
