La Constitución de la República Bolivariana de Venezuela es la ley fundamental de la nación, define el régimen de los derechos y libertades de los ciudadanos y delimita los poderes e instituciones de la organización política.Luego de la convocatoria de referéndum del 25 de abril de 1999 los venezolanos aceptaron de forma contundente la necesidad de renovar la Carta magna de 1961. Iniciando con ello los trabajos de la Asamblea Constituyente que terminarían el 17 de noviembre de 1999 con la presentación del futuro texto constitucional, él cual sería sometido a referéndum, celebrado el 15 de diciembre de ese mismo año, siendo aprobada por mayoría absoluta.Entre los temas más controversiales planteados en la Carta resalta el título VI donde se establece los lineamientos generales del sistema económico que prevalecerá en el país. Destacándose en este la búsqueda de la Justicia Social, la Democracia, la Libre Competencia y la Protección del Ambiente, entre otras muchas tareas. Es notorio el esfuerzo por dejar en claro la necesidad de compartir esfuerzos entre el Estado y la Iniciativa Privada.En dos ocasiones se ha buscado su modificación: En 2007 a través de un amplio abanico de reformas que acercaban al país a la vía socialista, pero que fue rechazada en cerrada votación por la vía del referéndum; y en 2009 cuando se permitió la reelección en cualquier puesto de elección popular, inclusive la presidencia de la república.
