La obra titulada “Reconocimiento de los Derechos de los pueblos indígenas en el marco constitucional del Ecuador” buscar dar una mirada al tema del reconocimiento de los derechos de los pueblos, las comunidades y nacionalidades indígenas; A partir del entendimiento de la aplicación de la jurisdicción indígena la cual se encuentra reconocida a nivel constitucional e internacional. Sin embargo en la actualidad la existencia de casos penales que han sido juzgados bajo la jurisdicción indígena y con posterioridad la jurisdicción ordinaria; ha hecho evidente un conflicto entre sistemas jurídicos con consecuencias presuntas de vulneración de derechos constitucionales; específicamente al principio de prohibición de doble juzgamiento. Lo mencionado anteriormente extiende la idea de justicia indígena u otro sistema de administración de justicia, diferente a la ordinaria, ya que para muchos esta idea de justicia ancestral resulta vulneradora de derechos humanos, consagrados e inherentes al ser humano, para otros la justicia indígena es considerada más eficaz y eficiente en el ámbito de orden social. Es allí el conflicto de competencia y jurisdicción en los diferentes sistemas jurídicos, respecto al ámbito penal, en el cual se identifica el daño al bien jurídico protegido, especialmente la vida e integridad físicas de la víctima. Por consiguiente, a lo manifestado este libro tratará los temas relacionados con la justicia consuetudinaria, las decisiones indígenas en su territorio y los principios y valores que guía el debido proceso para la emisión de resoluciones indígenas en cuanto a delitos penales y la posible vulneración de los derechos humanos desde el punto de vista de la justicia ordinaria.

He traces the history of modern law as an abyssal law, or a kind of law that is theoretically invisible yet implements profound exclusions in practice. This abyssal line has been the key procedure used by modern modes of domination - capitalism, colonialism, and patriarchy - to divide people into two groups, the metropolitan and the colonial, or the fully human and the sub-human. Tom Paine's 'Agrarian Justice' (1797) continues to inspire progressive politicians today as a source of two contemporary policies, Land Value Taxation and Universal (Basic) Income (Citizen's Income). His starting point was the belief, widespread until the end of the eighteenth century, that the Earth is the common property of humankind. Rather than advocating the common ownership of land, he proposed that landowners 'owe to the community a ground-rent', the market rent of their land. He advocated that this be paid into a fund to be used for the benefit of all, both as a lump sum payment on reaching adulthood and as a pension for older people. He is well worth reading for his passion and rhetoric. This publication also includes a riposte written in the same year by Thomas Spence, who had published a similar but more radical proposal in 1776. It also contains a 20th century re-statement of individual and common rights to the Earth and a summary of the relevance of Agrarian Justice today.

Em face disso, convém investigar a receptibilidade dos organismos jurisdicionais internacionais ante o constitucionalismo plurinacional. Assim, questiona-se: A Corte Interamericana de Direitos Humanos leva em consideração as premissas da plurinacionalidade nas demandas sentenciadas em fase de supervisão acerca dos territórios indígenas? Através de pesquisa empírica quali-quanti, buscar-se-á aferir a sensibilidade dialógica desse organismo jurisdicional à diversidade territorial vivenciada historicamente pelos povos originários latino-americanos. Para tanto, foram submetidas à análise todas as sentenças em atual fase de supervisão relacionadas às demandas fundiárias entre Estados e povos indígenas. Interessa saber se a Corte considera como critério decisório aspectos como abertura dialógica, ancestralidade e espiritualidade, bem como se incorpora em sua jurisprudência as amplas concepções de territorialidade existentes.
