The world appears to be globalising economically, technologically and even, to a halting extent, politically. This process of globalisation raises the possibility of an international legal framework, a possibility which has gained pressing relevance in the wake of the recent global economic crisis. But for any international legal framework to exist, normative agreement between countries, with very different political, economic, cultural and legal traditions, becomes necessary. This work explores the possibility of such a normative agreement through the prism of national constitutional norms. Since 1945, more than a hundred countries have adopted constitutional texts which incorporate, at least in part, a Bill of Rights. These texts reveal significant similarities; the Canadian Charter of Rights and Freedoms, for instance, had a marked influence on the drafting of the Bill of Rights for South Africa, New Zealand and Hong Kong as well as the Basic Law of Israel. Similarly, the drafts of Eastern European constitutions reflect significant borrowing from older texts. The essays in this book examine the depth of these similarities; in particular the extent to which textual borrowings point to the development of foundational values in these different national legal systems and the extent of the similarities or differences between these values and the priorities accorded to them. From these national studies the work analyses the rise of constitutionalism since the Second World War, and charts the possibility of a consensus on values which might plausibly underpin an effective and legitimate international legal order.

"(...) a presente pesquisa se propõe a oferecer elementos que auxiliem na detecção de verdadeiras mutações constitucionais e na expurgação das regulações extrajurídicas usurpadoras de seu papel social, blindando, contra estas, a Constituição. Para tanto, após um escorço histórico e sociológico dos contextos em que surgiram os questionamentos acerca da mutação constitucional, tentou-se estabelecer alguns critérios que deverão ser profusamente desenvolvidos pela comunidade científica, a bem do pleno desenvolvimento da Teoria das Mutações Constitucionais. De acordo com esses critérios, as mutações constitucionais ocorrerão a partir de determinados pressupostos, com vistas a exercer determinadas funções, mediante a intervenção de determinados instrumentos e observando determinados limites. Por isso, engana-se quem pensa que a formulação teórica das mutações constitucionais e a sua inclusão no catálogo conceitual da dogmática constitucional põe em risco a ordem constitucional, por expô-la à desenfreada força normativa dos fatos, comprometendo de vez a segurança jurídica e algumas das conquistas mais caras da democracia representativa e do constitucionalismo moderno ou do positivismo escrito e da deontologia jurídica. O presente livro tem uma finalidade muito clara: contribuir para uma crítica intelectual qualificada contra o ativismo judicial. Ele tem duas origens, ambas distintas, embora entrelaçadas: uma próxima e outra remota. Quanto à fonte remota, eu não poderia hoje sequer indicar com precisão a data exata de seu começo. Basicamente, desde os tempos da graduação, quando vivi a virada para o chamado neoconstitucionalismo durante a primeira década dos anos 2000, a amplitude dos temas objeto da jurisdição constitucional e a imprevisibilidade de seus resultados já me causavam severa perplexidade.
