This original and compelling book argues that previous studies of John Stuart Mill's work have neglected his egalitarianism and thus seriously misunderstood his views. Morales demonstrates that Mill was fundamentally concerned with how the exercise of unjust or arbitrary power by some individuals over others sabotages the possibility of human well-being and social improvement. Mill therefore believed that 'perfect equality'--more than liberty--was the foundation of democracy and that democracy was a moral ideal for the organization of human life in all of its dimensions. By reinterpreting Mill, Morales also challenges twentieth-century views of liberalism, and addresses its contemporary communitarian and feminist critics.

We live in an era of constitution-making. New constitutions are appearing in historically unprecedented numbers, following regime change in some countries, or a commitment to modernization in others. No democratic constitution today can fail to recognize or provide for gender equality. Constitution-makers need to understand the gendered character of all constitutions, and to recognize the differential impact on women of constitutional provisions, even where these appear gender-neutral. This book confronts what needs to be considered in writing a constitution when gender equity and agency are goals. It examines principles of constitutionalism, constitutional jurisprudence, and history. Its goal is to establish a framework for a 'gender audit' of both new and existing constitutions. It eschews a simple focus on rights and examines constitutional language, interpretation, structures and distribution of power, rules of citizenship, processes of representation, and the constitutional recognition of international and customary law. It discusses equality rights and reproductive rights as distinct issues for constitutional design.

Equality in Liberty and Justice is an integrated collection of essays in political philosophy, divided into two parts. The first examines (classically) liberal ideas-the ideas of the Founding Fathers of the American republic-and some of the applications and the rejections of such ideas in our contemporary world. Among other questions about liberty and responsibility it considers, in the context of the imprisonment and psychiatric treatment of dissidents in the psychiatric hospitals of the former Soviet Union, Plato's suggestion that all delinquency is an expression of mental disease. The second part examines the relations and the lack of relations between old fashioned, without prefix or suffix, justice and what is called by its promoters social justice. It therefore presses such questions as "Equal outcomes or equal justice?" and "Enemies of poverty or of inequality?" Equality in Liberty and Justice was originally published before the winning of the Cold War and the collapse of the Soviet Empire. This second edition updates the arguments of the previous editor and draws present day moral conclusions. This book will appeal to those for whom the classical liberal and conservative debates still have great meaning. Flew might well be the most significant sunthesizer of Tocqueville and Mill.

"One of the most vexing problems in the theory and practice of politics is the issue of difference. How do we build a just and stable polity in the face of identity differences that have historically been the basis for inequality, injustice, and violence? Such differences can take a variety of forms, including religious difference, race and ethnicity, language difference, urban/rural tensions, and gender. In many countries, divisions such as these are the fault lines that threaten the stability of the social and legal order. This book addresses the role of constitutions and constitutionalism in dealing with the challenge of difference. In the spring of 2011, a conference held at Indiana University brought together a distinguished group of lawyers, political scientists, historians, religious studies scholars, and area studies experts to consider how constitutions and constitutionalism address issues of difference across a wide swath of the world we called "Pan-Asia." Pan-Asia runs from the Middle East, through Central Asia, South Asia, Southeast Asia, East Asia, and into Oceania. This is a meta-region across which ideas and influences have traveled for centuries. It is also an area of the world that includes every type of difference in abundant supply. Pan-Asia, therefore, provides a wonderful laboratory for examining the role of constitutions in addressing difference. Until recently, age discrimination attracted little social opprobrium. However, ageism has now been thrust onto the equality agenda by the spectre of an ageing population. This has led to a range of policies on 'active ageing.' Most importantly, legally binding legislation prohibiting age discrimination in employment will need to be in place by 2006. Remarkably little attention has been paid to the key issues. To what extent is age inevitably linked with declining capacity? What are the central aims of a policy on age equality, and how can these be realised in law? How should law and policy address age discrimination in health, education and employment? What lessons can be learned from the US and Europe? And should young people be dealt with in the same way as older people? This book answers these questions in a series of chapters by experts from a wide range of disciplines. It begins by examining the nature of the ageing process and then turns to a detailed analysis of the concept of age equality. In the light of this analysis, the following three chapters critically assess employment, education, and health. A separate chapter is devoted to discrimination against children. The last two chapters consider the experience in the US, and other European countries.
