The “constitutionalization” of international law is one of the most intensely debated issues in contemporary international legal doctrine. The term is used to describe a number of features which distinguish the present international legal order from “classical” international law, in particular its shift from bilateralism to community interest, and from an inter-state system to a global legal order committed to the well-being of the individual person. The author of this book belongs to the leading participants of the constitutionalization debate. He argues that there indeed exists a constitutional law of the international community that is built on and around the Charter of the United Nations. In this book, he explains why the Charter has a constitutional quality and what legal consequences arise from that characterization.

Since the second edition of this commentary on the Charter of the United Nations was published, the text of the Charter may not have changed but the world has. The wars in Iraq and Afghanistan have had a lasting impact on international law and the Commentary has been fully updated to take their impact into account. The new edition has been completely revised and features a completely new chapter on UN reform, analyzing the effect of reforms which have already been implemented and examining why other proposals for reform have failed. It will assess how these proposals could be improved, with a particular focus on the Security Council. This new edition also includes coverage of the creation of the Human Rights Council and the impact of the Responsibility to Protect doctrine. This is the authoritative, article-by-article account of the legislative history, interpretation, and practical application of each and every Charter provision. Written by a team of distinguished scholars and practitioners, this book combines academic research with the insights of practice, and is an indispensable work of reference for all those interested in the UN.The Commentary will be crucial in providing new directions for the development of international law and the United Nations in the twenty-first century.

Academic Paper from the year 2018 in the subject Politics - Topic: International Organisations, University of Benin, course: INTERNATIONAL RELATIONS, language: English, abstract: This paper x-rayed the origin of the United Nations. Also, of fundamental importance of this study is the administration of the organs of the United Nations and their roles and functions to the organisation and the international system in particular. This study also beamed its search light on some specialised agencies of the United Nations and looked at global events that informed and propel the formation and establishment of the United Nations. This paper adopted the secondary method of data collection and as well, adopted four theoretical frameworks for its analysis, such as: Elite theory, the principle of Balance of Power, Realism and Liberalism and structural functionalism. it was found that the UN six main organs carry out functions assigned to them by the charter establishing the body and they are tailored to stabilize and ensure peaceful relations among nations of the world, it was also found that the UN functions are hampered by issues of finance, member nations agitation for restructuring the world body and problem of enforcement. In conclusion, it was recommended that the UN do all within its power to listen and respond to agitation for restructuring of the world body if the agitation is coming from majority of its member. It should be responsive to the compelling and majority demand of its members. With this, the issue of insolvency will be mitigated as member will contribute more to success story and victories of the world body.
