The authors address issues of representation - the move to a proportional electoral system in New Zealand, the unsuccessful attempt to establish a domestic head of state in Australia, and the reform of the British House of Lords - and demonstrate that citizens increasingly want legislative institutions to more closely reflect the societies they serve. To discuss responsiveness, the governance of indigenous communities and their place within the broader society in Canada and New Zealand are examined, as is the role of institutions other than legislatures that are involved in protecting minority rights and responding to various forms of diversity. A separate chapter analyses the basis for and merits of proposals to reform the Canadian House of Commons. In addition, authors review the dynamics of federalism, intergovernmental relations, and other processes of multi-level governance in Canada, the United Kingdom, and South Africa. Public debate about adapting governance processes to changing conditions and citizen values is a necessary condition of successful democracies and there is much to learn from progress and false starts in other parliamentary democracies. Contributors include Jonathan Boston (Victoria University of Wellington, New Zealand), Paul Chartrand (consultant, Victoria, British Columbia), Stéphane Dion (minister of Intergovernmental Relations, Government of Canada), David Docherty, Mason Durie (Massey University), Robert Hazell (University College London), Christina Murray (University of Cape Town), Cheryl Saunders (University of Melbourne), Leslie Seidle, Jennifer Smith (Dalhousie University), and Lord Wakeham (former chairman of the Royal Commission on House of Lords Reform).

The Uk S Changing Democracy written by Patrick Dunleavy and has been published by LSE Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-11-01 with Political Science categories.
The UK’s Changing Democracy presents a uniquely democratic perspective on all aspects of UK politics, at the centre in Westminster and Whitehall, and in all the devolved nations. The 2016 referendum vote to leave the EU marked a turning point in the UK’s political system. In the previous two decades, the country had undergone a series of democratic reforms, during which it seemed to evolve into a more typical European liberal democracy. The establishment of a Supreme Court, adoption of the Human Rights Act, Scottish, Welsh and Northern Irish devolution, proportional electoral systems, executive mayors and the growth in multi-party competition all marked profound changes to the British political tradition. Brexit may now bring some of these developments to a juddering halt. The UK’s previous ‘exceptionalism’ from European patterns looks certain to continue indefinitely. ‘Taking back control’ of regulations, trade, immigration and much more is the biggest change in UK governance for half a century. It has already produced enduring crises for the party system, Parliament and the core executive, with uniquely contested governance over critical issues, and a rapidly changing political landscape. Other recent trends are no less fast-moving, such as the revival of two-party dominance in England, the re-creation of some mass membership parties and the disruptive challenges of social media. In this context, an in-depth assessment of the quality of the UK’s democracy is essential. Each of the 2018 Democratic Audit’s 37 short chapters starts with clear criteria for what democracy requires in that part of the nation’s political life and outlines key recent developments before a SWOT analysis (of strengths, weaknesses, opportunities and threats) crystallises the current situation. A small number of core issues are then explored in more depth. Set against the global rise of debased semi-democracies, the book’s approach returns our focus firmly to the big issues around the quality and sustainability of the UK’s liberal democracy.

This book analyses constitutional conventions as a powerful but largely neglected framework for studying the law and politics of constitutions. Constitutional conventions are the unwritten rules that inform and circumscribe the political behaviour of individuals, organisations, and a political system. They are as important as the formal legal rules that define written constitutions and shape modern states; yet, unlike formal written rules, conventions have received only limited scholarly attention. This book considers conventions as a lens to theorise and to analyse the institutional dynamics of contemporary constitutions. Interrogating constitutional conventions in a wide variety of contexts – including in Westminster parliamentary systems, in presidential systems, and in non-democratic regimes – the book offers new perspectives for understanding diverse aspects of constitutional politics such as the capacity of conventions to constrain populists, how conventions influence constitutional transformation, how they reflect and reshape core democratic values such as citizenship and constitutional identity, and what they reveal about the character of authoritarian regimes. The book thus demonstrates how the dynamics of conventions shape the very character of constitutions. The book will be of interest to legal theorists, constitutional lawyers, and political scientists.

Constitution Making In Asia written by H. Kumarasingham and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-03-31 with History categories.
Britain’s main imperial possessions in Asia were granted independence in the 1940s and 1950s and needed to craft constitutions for their new states. Invariably the indigenous elites drew upon British constitutional ideas and institutions regardless of the political conditions that prevailed in their very different lands. Many Asian nations called upon the services of Englishman and Law Professor Sir Ivor Jennings to advise or assist their own constitution making. Although he was one of the twentieth century’s most prominent constitutional scholars, his opinion and influence were often controversial and remain so due to his advocating British norms in Asian form. This book examines the process of constitutional formation in the era of decolonisation and state building in Asia. It sheds light upon the influence and participation of Jennings in particular and British ideas in general on democracy and institutions across the Asian continent. Critical cases studies on India, Pakistan, Sri Lanka, Malaysia and Nepal – all linked by Britain and Jennings – assess the distinctive methods and outcomes of constitution making and how British ideas fared in these major states. The book offers chapters on the Westminster model in Asia, Human Rights, Nationalism, Ethnic politics, Federalism, Foreign influence, Decolonisation, Authoritarianism, the Rule of Law, Parliamentary democracy and the power and influence of key political actors. Taking an original stance on constitution making in Asia after British rule, it also puts forward ideas of contemporary significance for Asian states and other emerging democracies engaged in constitution making, regime change and seeking to understand their colonial past. The first political, historical or constitutional analysis comparing Asia’s experience with its indelible British constitutional legacy, this book is a critical resource on state building and constitution making in Asia following independence. It will appeal to students and scholars of world history, public law and politics.
