Both human rights and globalization are powerful ideas and processes, capable of transforming the world in profound ways. Notwithstanding their universal claims, however, the processes are constructed, and they draw their power from the specific cultural and political contexts in which they are constructed. Far from bringing about a harmonious cosmopolitan order, they have stimulated conflict and opposition. In the context of globalization, as the idea of human rights has become universal, its meaning has become one more terrain of struggle among groups with their own interests and goals. Part I of this volume looks at political and cultural struggles to control the human rights regime -- that is, the power to construct the universal claims that will prevail in a territory -- with respect to property, the state, the environment, and women. Part II examines the dynamics and counterdynamics of transnational networks in their interactions with local actors in Iran, China, and Hong Kong. Part III looks at the prospects for fruitful human rights dialogiue between competing universalisms that by definition are intolerant of conradiction and averse to compromise.

Alfredson argues that such cases, which unfold in the context of a specific country and have profound impacts on international human rights efforts, have been neglected in research and pose a challenge to recent theorizing on human rights change. In the early 1990s, Canada witnessed the emergence of the world's first comprehensive refugee policy for women who were seeking protection from female-specific forms of violence—rape, domestic abuse, public stoning of adulterers, genital mutilation—while challenging a gender-biased system. Close examination of this novel movement, Alfredson contends, provides crucial insights into why and how states may articulate new human rights that set international precedents. Analyzing original empirical data and sociopolitical historical trends, the book documents the decisive global impacts of the movement while shedding light on the paradox of noncitizen politics and asylum seekers' little recognized political strength. Contrary to expectation, findings suggest transnational networks and pressures are not required for some forms of change. Rather, international trigger cases illuminate a range of other key actors and advocacy strategies leading, subsequently, to a more comprehensive understanding of human rights acceptance. In the case of the women's refugee movement, the convergence of human rights and noncitizen politics points toward a new dimension for human rights scholarship that, in the current age of globalization, is becoming critically important.

This book argues that the effectiveness of the state apparatus is one of the crucial variables determining human rights conditions, and that state weakness and failure is responsible for much of the human rights abuses we see today. Weak states are unable to control their own agents or to police abuses by private actors, resulting in less accountability and more abuse. By contrast, stronger states have greater capacities to protect human rights; even strong authoritarian states tend to have better human rights conditions than weak ones. The first two chapters of the book develop the theoretical connections between international law, sovereignty, states and rights, and the consequences of state failure for these relationships. The empirical chapters (Chapters 3-6) test the validity of these theoretical claims, employing a multi-method approach that combines quantitative and qualitative methods. Englehart uses case studies of Afghanistan, Burma/Myanmar and the Indian state of Bihar to analyze types and patterns of state failure, based on analysis of NGO reports, archival research, primary and secondary texts, and interviews and field research. Examining what happens to human rights when states fail, the book concludes with implications for scholars and activists concerned with human rights. Human rights refers to the concept of human beings as having universal rights, or status, regardless of legal jurisdiction, and likewise other localising factors, such as ethnicity and nationality. For many, the concept of "human rights" is based in religious principles. However, because a formal concept of human rights has not been universally accepted, the term has some degree of variance between its use in different local jurisdictions -- difference in both meaningful substance as well as in protocols for and styles of application. Ultimately the most general meaning of the term is one which can only apply universally, and hence the term "human rights" is often itself an appeal to such transcended principles, without basing such on existing legal concepts. The term "humanism" refers to the developing doctrine of such universally applicable values, and it is on the basic concept that human beings have innate rights, that more specific local legal concepts are often based. Within particular societies, "human rights" refers to standards of behaviour as accepted within their respective legal systems regarding 1) the well being of individuals, 2) the freedom and autonomy of individuals, and 3) the representation of the human interest in government. These rights commonly include the right to life, the right to an adequate standard of living, the prohibition of genocide, freedom from torture and other mistreatment, freedom of expression, freedom of movement, the right to self-determination, the right to education, and the right to participation in cultural and political life. These norms are based on the legal and political traditions of United Nations member states and are incorporated into international human rights instruments.
