Americans have always cherished our privacy. From the birth of our republic, we assured ourselves protection against unlawful intrusion into our homes and our personal papers. At the same time, we set up a postal system to enable citizens all over the new nation to engage in commerce and political discourse. Soon after, Congress made it a crime to invade the privacy of the mails. And later we extended privacy protections to new modes of communications such as the telephone, the computer, and eventually email.

Strong consumer data privacy protections are essential to maintaining consumers' trust in the technologies and co. that drive the digital economy. The existing framework in the U.S. effectively addresses some privacy issues, but additional protections are necessary to preserve consumer trust. The framework set forth in this document by the Obama Admin. will provide these protections while promoting innovation. It consists of 4 key elements: (1) a Consumer Privacy Bill of Rights; (2) a process to specify how the principles in the Consumer Privacy Bill of Rights apply in bus. contexts; (3) effective enforcement; (4) and a commitment to increase interoperability with the privacy frameworks of our internat. partners. This book examines the role of the EU in ensuring privacy and data protection on the internet. It describes and demonstrates the importance of privacy and data protection for our democracies and how the enjoyment of these rights is challenged by, particularly, big data and mass surveillance. The book takes the perspective of the EU mandate under Article 16 TFEU. It analyses the contributions of the specific actors and roles within the EU framework: the judiciary, the EU legislator, the independent supervisory authorities, the cooperation mechanisms of these authorities, as well as the EU as actor in the external domain. Article 16 TFEU enables the Court of the Justice of the EU to play its role as constitutional court and to set high standards for fundamental rights protection. It obliges the European Parliament and the Council to lay down legislation that encompasses all processing of personal data. It confirms control by independent supervisory authorities as an essential element of data protection and it gives the EU a strong mandate to act in the global arena. The analysis shows that EU powers can be successfully used in a legitimate and effective manner and that this subject could be a success story for the EU, in times of widespread euroskepsis. It demonstrates that the Member States remain important players in ensuring privacy and data protection. In order to be a success story, the key stakeholders should be prepared to go the extra mile, so it is argued in the book. The book is based on academic research for which the author received a double doctorate at the University of Amsterdam and the Vrije Universiteit Brussels. It builds on a long inside experience within the European institutions, as well as within the community of data protection and data protection authorities. It is a must read in a time where the setting of EU privacy and data protection is changing dramatically, not only as a result of the rapidly evolving information society, but also because of important legal developments such as the entry into force of the General Data Protection Regulation. This book will appeal to all those who are in some way involved in making this regulation work. It will also appeal to people interested in the institutional framework of the European Union and in the role of the Union of promoting fundamental rights, also in the wider world.

Advances in health information technology (health IT) have the potential to improve the quality of healthcare, to increase the availability of health information for treatment, and to implement safeguards that cannot be applied easily or cost-effectively to paper-based health records. However, the digitization of health information is also raising new privacy risks and concerns. Sensitive health information in digital form is more easily aggregated, used, and shared. In addition, the rising cost of healthcare and the search for efficiency may create incentives to use the information in new ways. Research has consistently shown that while the public sees the potential value of health information exchange and technological advancements, it remains gravely concerned about the privacy of their sensitive health information. As a result, it is becoming increasingly clear that ensuring public trust will be critical to the successful implementation of nationwide health information exchange. The purpose of this second edition is two-fold: 1) to educate readers about privacy concepts and 2) highlight key privacy issues facing the nation and the healthcare community as it moves towards electronic health records and health information exchange. The first three chapters are descriptive in nature, defining privacy and distinguishing it from security, defining the complex legal landscape for health information privacy, and setting the stage for the following chapters by describing the current landscape of the evolving healthcare environment. The following chapters discuss specific privacy issues and challenges in detail. The book concludes with a chapter providing a view to the future of healthcare and the association privacy implications. This is an updated version of one of HIMSS’ best-selling books on information privacy.

Market Integration Through Data Protection written by Mario Viola de Azevedo Cunha and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-02-26 with Law categories.

In the context of the continuous advance of information technologies and biomedicine, and of the creation of economic blocs, this work analyzes the role that data protection plays in the integration of markets. It puts special emphasis on financial and insurance services. Further, it identifies the differences in the data protection systems of EU member states and examines the development of common standards and principles of data protection that could help build a data protection model for Mercosur. Divided into four parts, the book starts out with a discussion of the evolution of the right to privacy, focusing on the last few decades, and taking into account the development of new technologies. The second part discusses the interaction between data protection and specific industries that serve as case studies: insurance, banking and credit reporting. The focus of this part is on generalization and discrimination, adverse selection and the processing of sensitive and genetic data. The third part of the book presents an analysis of the legislation of three EU Member States (France, Italy and UK). Specific elements of analysis that are compared are the concepts of personal and anonymous data, data protection principles, the role of the data protection authorities, the role of the data protection officer, data subjects’ rights, the processing of sensitive data, the processing of genetic data and the experience of the case studies in processing data. The book concludes with the proposal of a model for data protection that could be adopted by Mercosur, taking into account the different levels of data protection that exist in its member states.

The value of personal data has traditionally been understood in ethical terms as a safeguard for personality rights such as human dignity and privacy. However, we have entered an era where personal data are mined, traded and monetized in the process of creating added value - often in terms of free services including efficient search, support for social networking and personalized communications. This volume investigates whether the economic value of personal data can be realized without compromising privacy, fairness and contextual integrity. It brings scholars and scientists from the disciplines of computer science, law and social science together with policymakers, engineers and entrepreneurs with practical experience of implementing personal data management. The resulting collection will be of interest to anyone concerned about privacy in our digital age, especially those working in the field of personal information management, whether academics, policymakers, or those working in the private sector.

Data Protection On The Move written by Serge Gutwirth and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-01-09 with Law categories.

This volume brings together papers that offer methodologies, conceptual analyses, highlight issues, propose solutions, and discuss practices regarding privacy and data protection. It is one of the results of the eight annual International Conference on Computers, Privacy, and Data Protection, CPDP 2015, held in Brussels in January 2015. The book explores core concepts, rights and values in (upcoming) data protection regulation and their (in)adequacy in view of developments such as Big and Open Data, including the right to be forgotten, metadata, and anonymity. It discusses privacy promoting methods and tools such as a formal systems modeling methodology, privacy by design in various forms (robotics, anonymous payment), the opportunities and burdens of privacy self management, the differentiating role privacy can play in innovation. The book also discusses EU policies with respect to Big and Open Data and provides advice to policy makers regarding these topics. Also attention is being paid to regulation and its effects, for instance in case of the so-called ‘EU-cookie law’ and groundbreaking cases, such as Europe v. Facebook. This interdisciplinary book was written during what may turn out to be the final stages of the process of the fundamental revision of the current EU data protection law by the Data Protection Package proposed by the European Commission. It discusses open issues and daring and prospective approaches. It will serve as an insightful resource for readers with an interest in privacy and data protection.
