The question of how financial services should be regulated in the interests of consumers has never been more topical. The structure of the financial services industry is changing rapidly and the need for the law to keep pace with these changes has never been greater. This book examines the role of the law in the protection of the consumer, in particular the ways in which the law is, and could be, used to protect consumers when purchasing financial services. A prominent panel of contributors first examines the role of the European Union and the ombudsmen schemes operating in the United Kingdom in improving consumer protection. Eight expert papers present a detailed analysis of aspects of the various legal mechanisms protecting consumers in the banking, financial services, investments and insurance industries. The final part of the book is concerned with the important and controversial area of consumer credit. This unique work is a welcome contribution to a rapidly developing area of law, which has so far received little attention from commentators. It will be of great interest to those at the cutting edge of banking, financial services and consumer law, whether practicing lawyers or in-house counsel, and all those involved in advising consumers.

In the era where the concept of consumerism had made its stronghold in the field of consumer rights, it still awaits possible nourishments by redefining and addressing some issues pertaining to consumers laws in the service sector, especially for an educational institution. Changing dimensions and socio-legal conditions of the country have magnetized many issues igniting need to outlook the present scenario in the consumer protection area. Present consumer protection laws are facing a definitional challenge over the concept of consumers and a vigilant need arises to recheck the same. Students are in paradoxical situation pertaining to their inclusion as consumers and hence leaving them in legal detrimental juncture. It is well-settled concept that makes consumer laws applicable to the education sector by virtue of its nature as a service but the real implementation of above-mentioned concept subsequently defined by the paper will analyze and suggests corrective measures to address the issue. Education sector coming as any other service sector attracts greater concern to make a comprehensive approach to it. In the present study, a comprehensive scheme relating to consumer protection laws and its effect and potential changes have been proposed that may change the future of the nation and bring a new era for consumer protection.

Consumers justly demand fair treatment and high standards in the whole range of services including in the motor vehicle repair and service industry. Nevertheless, consumer services seem to be neglected compared to the attention paid to consumer sales, consumer credit and supply of goods. The rights of consumers to seek for redress mainly lie under the law of contract, the law of tort and the Consumer Protection Act 1999. This research seeks to come out with a comprehensive consumer protection in the service industry with special reference to the motor vehicle repair and service. In doing so, the study focuses on the civil liabilities of service providers and the rights of consumers for redress. As such, this research analyses the extent to which the laws of Malaysia provides adequate protection to consumers. The discussion includes the analysis on the contract law, the tort law as well as the CPA. A small survey also has been carried out to get the consumers' viewpoints and feedbacks on the matters. This study proves that there are many hindrances under the contract law and the tort law for the consumers to seek for remedies. In addition, there exist lacunae and ambiguity in the statutory provisions under the CPA which need further amendments. Though, the Tribunal for Consumer Claims is able to provide for a good alternative redress mechanism to consumers which are cheap, quick and relatively informal manner, there are several drawbacks in the operation of the TCC that need further improvements in order to maximize it as the best redress mechanism for consumers. By the end of the research, the researcher outlines several proposals for amendments in the interest of all Malaysian consumers so that they will get optimum protection especially in the motor vehicle repair and service industry. Hopefully, this research can benefit many people such as the academicians, consumers, legislators, law enforcers and service providers.

Eu Competition Law The Consumer Interest And Data Protection written by Federico Ferretti and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-07-24 with Law categories.

The legitimacy or illegitimacy of information exchanges between competitors remains a topical debate with regard to EU competition law and policy. This book reexamines the issue in the retail financial services sector, focusing on the peculiar problems that it poses for EU market integration, consumer policy and protection and the intersection with fundamental rights. It analyzes and reflects on the relevant case law and guidelines offered by the corresponding European authorities, providing a critique of the current approach and advancing the proposition that information markets themselves need attention, in addition to the markets that they serve. The book also advances new perspectives on cases in which consumers’ personal information is involved in the exchange, recognizing the inevitable interaction between EU competition law, the interests and protection of consumers and personal data protection. It suggests that the status quo under competition law is unsatisfactorily short sighted and that the EU should take a holistic approach (including information markets) to the analysis of competition law, reflecting consumer protection and fundamental rights aspects in the assessment.
