This book explores the changing nature of international law and its ability to respond to the contemporary issues related to international environment, trade and information technology. The evolution of international law has reached a stage where we are witnessing diminishing power of the state and its capacity to deal with the economic matters challenging the existing notions of territory and sovereignty. Recent trends in international law and international relations show that states no longer have exclusive control over the decision-making process at the global level. Keeping this in mind, the book brings together the perspectives of various international and national scholars. The book considers diverse issues such as, sustainable development, climate change, global warming, Rio+20, technology transfer, agro-biodiversity and genetic resource, authority for protection of environment, human right to water, globalization, human rights, sui generis options in IP laws, impact of liberalization on higher education, regulation of international trade, intellectual property rights, collective administration of copyright, broadcast reproduction rights, implementation of copyright law, communication rights under copyright law, arbitration for IP disputes, doctrine of exhaustion of rights, trans-border reputation of trademark, information as an asset, cyber obscenity and pornography, e-governance, taxation of e-commerce, computer crime, information technology, domain names, research excellence in legal education, ideological perspective on legal education, challenges for law teachers, and clinical legal education. The topics, though diverse, are closely interrelated, with the common concern throughout being that the global environment, international trade, information technology and legal education need appropriate national normative and institutional responses as well as the global cooperation of members of the international community. Presenting reflections of a number of Asian, African and European scholars on these varied facets, the book is of great value to scholars, practitioners, teachers and students associated with contemporary international law.

This book is a collection of essays dealing with issues of contemporary significance in the law of treaties. It neither purports nor aspires to provide a general overview of all aspects of the law of treaties, and it is by no means intended to be a comprehensive textbook. The discussion of the subjects selected in this book will shed some light on a number of areas of the contemporary law of treaties, and, consequently, on some important features of the international legal system at the beginning of the twenty-first century. The relevance of the rules governing the law of treaties for other central fields of international law continue to be the subject of frequent doctrinal discussion. In addition, some rapidly developing newer areas of public international law, which are regulated for the most part by treaties, have renewed the importance of some older problems, for example, the question of conflicts between treaties regulating the same subject-matter and the matter of treaty interpretation. One other important issue is the relevance of the emergence of new actors and factors, other than states, in the international legal order in general, and in the law of treaties in particular.

"Whether International Law is really law is one of those vexed questions that still linger. Prof. Mwenda's three-pillar approach to looking at International Law is an exceedingly useful conceptual framework which is, at the same time, emblematic of the malleable nature of the discipline. The analysis demonstrates when States pay attention to international law, why they feel compelled to do so, when they choose not to, and why all that matters. This is an extremely timely and accessible book which should be useful to the legal academy and to practitioners."-DR VICTOR B. MOSOTIChief Counsel for Environmental and International Law, Legal Vice-Presidency, The World Bank"Prof. Mwenda's book, 'Contemporary Issues in International Law', is a must-read masterpiece on international law for practitioners, academics and students of public international law. It is a thought-provoking book that touches on contemporary issues confronting international law at a time when multilateralism...is under serious threat. It touches on issues that need to be discussed and addressed in order to be able to deal with the emerging challenges of rising nationalism among leading nations of the world."-BRIAN CHIGAWA, ESQDirector of Legal and Corporate Affairs, Common Market for Eastern and Southern Africa (COMESA).

The aim of this book is to provide the reader with overviews of certain international law issues which recently have been and continue to be central on the international scene in the coming years. These issues are subdivided in four parts: Part I, The Rise of International Criminal Law and the Creation of the International Criminal Court; Part II, Human Rights and International Humanitarian Law in the Face of Terrorism; Part III, Aspects of International Law of the Sea; and Part IV, Water in International Law. Within this broad context, the book furthermore provides insights into aspects which are of particular interest, e.g. piracy in connection with 'International law of the Sea' or targeted killings in connection with 'HR and IHL in the face of Terrorism.' Examples of real-life problems are also laid out, e.g. those of the Nile and the Tigris/Euphrates Rivers in relation to 'Water in International Law.' The book will be of interest to professionals, diplomats, international lawyers and legal advisers. Law students will also benefit from it, particularly because the text is combined with extensive references for further study.

Since 1985, the Law School at the University of Hull has hosted an annual lecture - the Josephine Onoh Memorial Lecture - given by a distinguished international lawyer. These annual lectures are funded by the Josephine Onoh Memorial Fund, established in 1984 by the family and friends of Josephine Onoh who was tragically killed in an air crash at Enugu, Nigeria, in November 1983. Josephine was a Hull law graduate, and at the time of her death was registered at the University for a research degree in the field of international law. This book contains a collection of these annual lectures. The first lecture in 1985 was given by the late Judge Taslim Elias, at that time President of the International Court of Justice. Subsequent lectures have been given by both leading practitioners and professors of international law, including Sir Robert Jennings, Bin Cheng, Sir Ian Sinclair, Philip Allott, Henry Schermers, Lord Mackenzie-Stuart, Alexandre-Charles Kiss, Dame Rosalyn Higgins, Peter Sand, Ian Brownlie, Christopher Greenwood, Marti Koskenniemi, and Ralph Zacklin. The lectures reflect some of the most significant international concerns of the last two decades. The subjects they address include new trends in international law, international courts and politics, the practitioner's view of international law, international law and revolution, the European Convention of Human Rights, European Community law concepts, the global environment and international law, the current role of the United Nations, international environmental trust funds, international boundary law, international law and imperialism, and humanitarian intervention. This important collection of essays by some of the leading international law figures of our generation will be of equal value to all interested in international law, whether the academic or the practitioner.

This book simultaneously sheds light on the most pressing global challenges facing humanity in the 21st century and pays tribute to President Vaclav Havel of the Czech Republic, who had a great impact on the transformation of world politics in the 20th century. It examines in detail contemporary international issues such as climate change, mass migration, refugees, internal armed conflicts, great power rivalry, and regional political instability. It also underscores the increasing inability of the Westphalian model to solve complex transnational problems and calls for a new approach. Included as a postscript is an extensive analysis of the resurgence of dictatorial regimes in many regions of the world and their attempt to undo the rules-based international order established after World War II. This trend is a setback for those who fought tirelessly to end the Cold War and to spread freedom and democracy to millions of people across the globe. Today that legacy is being challenged by autocratic regimes that see respect for human rights as a threat to their political survival. International law is what unites us as citizens of the world; and only through international law and multilateral cooperation, can we address the global challenges examined in this book.

The United States spearheaded the creation of many international organizations and treaties after World War II and maintains a strong record of compliance across several issue areas, yet it also refuses to ratify major international conventions like the UN Convention on the Law of the Sea and the Convention on the Elimination of All Forms of Discrimination Against Women. Why does the U.S. often seem to support international law in one way while neglecting or even violating it in another? The United States and International Law: Paradoxes of Support across Contemporary Issues analyzes the seemingly inconsistent U.S. relationship with international law by identifying five types of state support for international law: leadership, consent, internalization, compliance, and enforcement. Each follows different logics and entails unique costs and incentives. Accordingly, the fact that a state engages in one form of support does not presuppose that it will do so across the board. This volume examines how and why the U.S. has engaged in each form of support across twelve issue areas that are central to 20th- and 21st-century U.S. foreign policy: conquest, world courts, war, nuclear proliferation, trade, human rights, war crimes, torture, targeted killing, maritime law, the environment, and cybersecurity. In addition to offering rich substantive discussions of U.S. foreign policy, their findings reveal patterns across the U.S. relationship with international law that shed light on behavior that often seems paradoxical at best, hypocritical at worst. The results help us understand why the United States engages with international law as it does, the legacies of the Trump administration, and what we should expect from the United States under the Biden administration and beyond.
