While the definition of what may constitute a controversial land use differs from community to community, the bottom line is that land use controls have been attempting to regulate these uses since the advent of zoning (and through nuisance law before that). When regulating many types of controversial land uses, constitutional issues may come into play and federal and state preemption issues may arise. However, local governments typically have wide discretion in designing standards and regulations for many types of controversial uses. This article explores four typically controversial uses - off-campus fraternity and sorority housing, tattoo parlors, medical marijuana and pawn shops - to demonstrate the types of regulations that may and may not be appropriate when it comes to planning and zoning laws.

Land use has important consequences for the environment, public health, economic productivity, inequality and social segregation. Land use policies are often complex and require co-ordination across all levels of government as well as across policy sectors. Not surprisingly, land use decisions can be contentious and conflicts over land use are common across the OECD. This report argues that better land use governance requires the use of a broader set of public policies to influence land use. In particular, the incentives for particular land uses provided by fiscal instruments and tax policies need to be better aligned with land use objectives. The report furthermore analyses land use patterns across the OECD based on comprehensive land cover data. It shows that developed land is growing everywhere, but great variation exists between countries. Lastly, the report summarises insights from six in-depth case studies to show concrete examples of land use related challenges in OECD countries and the response of national, regional and local governments to them.

The looming depletion of non-renewable resources has increased the global land grab in the past decade. So far however, the question of how and when people can influence economic outcomes has received little attention in the study of social movements. Based on in-depth ethnographic field research since 2003 in the industrial forestry expansion frontiers in Brazil and elsewhere in the global South, this book presents a novel theory to explain how the interaction between resistance, companies and the state determines investment outcomes. The promotion of contentious agency by organizing and politicizing, campaigning, protesting, networking and engaging in state and corporate-remediated politics whilst maintaining autonomy is central to explaining how impacted people influence resource flows, and block or slow projects they deem harmful to their livelihoods and the environment. The conflicts between globalizing paper and pulp corporations and the landless peasants, indigenous communities and other parties with alternative projects for the planet’s future are studied to illustrate how a great transformation can be built upon progressive counter-movements. This systematic comparison of several cases illustrates the broader principles and problems endemic to the global political economy.
