This new book shows how citizenship, and its meaning and form, has become a vital site of contestation. It clearly demonstrates how whilst minority groups struggle to redefine the rights of citizenship in more pluralized forms, the responsibilities of citizenship are being reaffirmed by democratic governments concerned to maintain the common political culture underpinning the nation. In this context, one of the central questions confronting contemporary state and their citizens is how recognition of socio-cultural ‘differences’ can be integrated into a universal conception of citizenship that aims to secure equality for all. Equality policies have become a central aspect of contemporary European public policy. The ‘equality/difference’ debate has been a central concern of recent feminist theory. The need to recognize diversity amongst women, and to work with the concept of ‘intersectionality’ has become widespread amongst political theory. Meanwhile European states have each been negotiating the demands of ethnicity, disability, sexuality, religion, age and gender in ways shaped by their own institutional and cultural histories. Global Indian Diasporas discusses the relationship between South Asian emigrants and their homeland, the reproduction of Indian culture abroad, and the role of the Indian state in reconnecting emigrants to India. Focusing on the limits of the diaspora concept, rather than its possibilities, this volume presents new historical and anthropological research on South Asian emigrants worldwide. From a comparative perspective, examples of South Asian emigrants in Suriname, Mauritius, East Africa, Canada, and the United Kingdom are deployed in order to show that in each of these regions there are South Asian emigrants who do not fit into the Indian diaspora concept—raising questions about the effectiveness of the diaspora as an academic and sociological index, and presenting new and controversial insights in diaspora issues.

In its political form, the existence of a public realm is the basis of a shared relationship between rulers and ruled which makes politics more than mere power or domination. How to construct and maintain a public realm in the political sphere is, however, a matter of especial dispute at the present day, due partly to the increasing difficulty of making the distinction between public and private spheres which has been the basis of Western liberal democracy; partly to the tendency of public concerns to be identified with economic interests, which transforms citizens into consumers; partly to pressure for the acknowledgement of diversity of every kind, which creates the danger of fragmenting the public realm; and partly to globalization processes which have undermined the traditional identification of the public realm with national political institutions. Globalization has, in addition, raised the question of whether there can be a supra-national public realm and, more generally, of what form it is likely to assume in non-Western cultures. These are amongst the fundamental contemporary issues addressed by contributors to the present volume. In Frontiers of Gender Equality, editor Rebecca Cook enlarges the chorus of voices to introduce new and different discourses about the wrongs of gender discrimination and to explain the multiple dimensions of gender equality. This volume demonstrates that the wrongs of discrimination can best be understood from the perspective of the discriminated, and that gender discrimination persists and grows in new and different contexts, widening the gap between the principle of gender equality and its realization, particularly for subgroups of women and LGBTQ+ peoples. Frontiers of Gender Equality provides retrospective views of the struggles to eliminate gender discrimination in national courts and international human rights treaties. Focusing on gender equality enables comparisons and contrasts among these regimes to better understand how they reinforce gender equality norms. Different regional and international treaties are examined, those in the forefront of advancing gender equality, those that are promising but little known, and those whose focus includes economic, social, and cultural rights, to explore why some struggles were successful and others less so. The book illustrates how gender discrimination continues to be normalized and camouflaged, and how it intersects with other axes of subordination, such as indigeneity, religion, and poverty, to create new forms of intersectional discrimination. With the benefit of hindsight, the book’s contributors reconstruct gender equalities in concrete situations. Given the increasingly porous exchanges between domestic and international law, various national, regional, and international decisions and texts are examined to determine how better to breathe life into equality from the perspectives, for instance, of Indigenous and Muslim women, those who were violated sexually and physically, and those needing access to necessary health care, including abortion. The conclusion suggests areas of future research, including how to translate the concept of intersectionality into normative and institutional settings, which will assist in promoting the goals of gender equality.

This book provides a complex insight into how law, as a distinct tool and technology, conceptualizes and operationalizes race, ethnicity and nationality. The focus of the comparative project, by bringing examples from five continents and scores of jurisdictions, as well as showcases for hybrid, intersectional groups, is specifically the morphology and dynamics of legal categorization. Separate discussions concentrate on conceptualizing groupness and membership, as well as agency and contestation. The book shows that although identity politics has dominated recent decades, ethno-racial self-identification is not the only operationalizing model legal regimes apply, especially with the recent boost in artificial intelligence (AI), and bio-genetic research. Examples for the “re-biologization” of ethno-racial conceptualization are brought from a wide range of legal regimes, including citizenship, anti-discrimination, asylum, and Indigenous law. The work provides a journey through the administrative-political construction and contestation of ethno-racial classifications, with particular attention paid to the concepts of free choice of identity, covering, and fraud, as well as the arbitrariness, the historical path dependence, and the role of merit in conceptualization. While the starting point of the book is to capture ethnicity as a category of law, it shows how legal conceptualization and operationalization are intertwined with categories of analysis and experience. The methodology applied is comparative constitutional and international law, but the research will have wider interdisciplinary appeal offering a novel perspective for a broad audience in social sciences and humanities.
