Many observers in colonial Spanish America—whether clerical, governmental, or foreign—noted the large numbers of forasteros, or Indians who were not seemingly attached to any locality. These migrants, or “wanderers,” offended the bureaucratic sensibilities of the Spanish administration, as they also frustrated their tax and revenue efforts. Ann M. Wightman’s research on these early “undocumentals” in the Cuzco region of Peru reveals much of importance on Andean society and its adaptation and resistance to Spanish cultural and political hegemony. The book thereby informs our understanding of social change in the colonial period. Wightman shows that the dismissal of the forasteros as marginalized rural poor is superficial at best, and through laborious and painstaking archival research she presents a clear picture of the transformation of traditional society as the native populations coped with the disruptions of the conquest—and in doing so, reveals the reciprocal adaptations of the colonial power. Her choice of Cuzco is particularly appropriate, as this was a “heartland” region crucial to both the Incan and Spanish empires. The questions addressed by Wightman are of great concern to current Andean ethnohistory, one of the liveliest areas of such research, and are sure to have an important impact.

Robert Nagel's innovative volume attempts to explain why, despite almost four decades of conservative and moderate appointments, the Supreme Court continues to intervene aggressively in a wide array of social and political issues. The explanation lies primarily in the psychological effects of the way that lawyers think about law and judging. The instincts ingrained by the experiences common to legal education and the successful practice of law also work to encourage the reckless use of power. Nagel argues that the problem with the modern judicial role is cultural and political. He demonstrates that judges, especially Supreme Court justices, have degraded our political discourse, intensified social conflict, and drained moral confidence. By examining modern Supreme Court confirmation hearings along with certain classic legal writings, Nagel shows how modern lawyers have a broad consensus on how to interpret the Constitution and, more generally, how to think about law. One major component of this mindset is to combine realism with legalism in ways that naturally tend to expand the judiciary's imperial role. Realism counsels that decisions are inevitably partly personal and therefore cannot be conclusively justified while legalism imparts the sense that the judge's interpretation is the best one possible. This combination of the personal and political, along with other aspects of modem legal thinking and training, means that judges are not only unconstrained by professional norms but actually are impelled by them to use power expansively. This issue is important to every person living in the U.S., as the Supreme Court's decisions concern everyone in the nation. A groundbreaking history of Africa’s looted architectural heritage—and a bold proposal for the repatriation of the continent’s stolen cultural artifacts Between the nineteenth century and today, colonial officials, collectors, and anthropologists dismembered African buildings and dispersed their parts to museums in Europe and the United States. Most of these artifacts were cataloged as ornamental art objects, which erased their intended functions, and the removal of these objects often had catastrophic consequences for the original structures. Africa’s Buildings traces the history of the collection and distribution of African architectural fragments, documenting the brutality of the colonial regimes that looted Africa’s buildings and addressing the ethical questions surrounding the display of these objects. Itohan Osayimwese ranges across the whole of Africa, from Egypt in the north to Zimbabwe in the south, and spanning the western, central, and eastern regions of the continent. She describes how collectors employed violent means to remove elements such as columns and door panels from buildings, and how these methods differentiated architectural collecting from conventional collecting. She shows how Western collectors mischaracterized building components as ornament, erasing their architectural character and concealing the evidence of their theft. Osayimwese discusses how the very act of displacing building parts like floor tiles and woven screen walls has resulted in a loss of knowledge about their original function and argues that because of these removals, scholars have yet to fully grasp the variety and character of African architecture. Richly illustrated, Africa’s Buildings uncovers the vast scale of cultural displacement perpetrated by the West and proposes a new role for museums in this history, one in which they champion the repatriation of Africa’s architectural heritage and restitution for African communities.
