Property relations are such a common feature of social life that the complexity of the web of laws, practices, and ideas that allow a property regime to function smoothly are often forgotten. But we are quickly reminded of this complexity when conflict over property erupts. When social actors confront a property regime – for example by squatting – they enact what can be called ‘contested property claims’. As this book demonstrates, these confrontations raise crucial issues of social justice and show the ways in which property conflicts often reflect wider social conflicts. Against the backdrop of international conventions and their implementation, Cultural Property and Contested Ownership explores how highly-valued cultural goods are traded and negotiated among diverging parties and their interests. Cultural artefacts, such as those kept and trafficked between art dealers, private collectors and museums, have become increasingly localized in a ‘Bermuda triangle’ of colonialism, looting and the black market, with their re-emergence resulting in disputes of ownership and claims for return. This interdisciplinary volume provides the first book-length investigation of the changing behaviours resulting from the effect of the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. The collection considers the impact of the Convention on the way antiquity dealers, museums and auction houses, as well as nation states and local communities, address issues of provenance, contested ownership, and the trafficking of cultural property. The book contains a range of contributions from anthropologists, lawyers, historians and archaeologists. Individual cases are examined from a bottom-up perspective and assessed from the viewpoint of international law in the Epilogue. Each section is contextualised by an introductory chapter from the editors.

Contested Sites in Jerusalem is the third and final volume in a series of books which collectively present in detail the work of the Jerusalem Old City Initiative, or JOCI, a major Canadian-led Track Two diplomatic effort, undertaken between 2003 and 2014. The aim of the Initiative was to find sustainable governance solutions for the Old City of Jerusalem, arguably the most sensitive and intractable of the final status issues dividing Palestinians and Israelis. This book examines the complex and often contentious issues that arise from the overlapping claims to the Temple Mount/Haram al-Sharif, the role of UNESCO, and the major implications of the JOCI Special Regime for such issues as archaeology, property, and the economy. Part I is dedicated to holy sites – ground zero of the Israeli–Palestinian conflict, a point reinforced by the autumn 2014 disturbances which threatened to spiral out of control and engulf Palestinians and Israelis in yet another wave of violence. Parts II–IV of the volume contain studies on archaeology, property, and economics that were written after the completion of the Special Regime model, specifically to address in depth how a Special Regime would deal with each of these three important areas. Contested Sites in Jerusalem offers an insightful explanation of the enormous challenges facing any attempt to find sustainable governance and security arrangements for the Old City in the context of a peace agreement between the Israelis and the Palestinians. It will therefore be of immense value to the policy-making community, as well as anyone in academia with a focus on Middle East politics, the Israeli–Palestinian conflict, and the Middle East peace process.

In this book, Rhodes provides a nonevaluative account of coercion. He begins with a thorough discussion of the charge that coercion is an essentially contested concept. He argues that effective communication of regulations pertaining to human conduct requires a basic level of clarity as to the kind of conduct being regulated. Accordingly, he argues that before we prescribe or proscribe conduct, we should describe it. In short, he maintains that wherever possible description should precede prescription and proscription. Rhodes begins his descriptive project by providing a fundamental account of human motivation. Upon this foundation he supports his distinctions between threats, offers, throffers, and neutral proposals. He argues that all coercion claims can be understood in light of these components. He applies this analysis to three prominent accounts of coercion as advanced by F.A. Hayek, Harry Frankfurt, and Robert Nozick. After comparing and contrasting these views, Rhodes provides his own account. Rhodes's account is based upon the identification of what he refers to as perceived-threat-avoidance-behavior as a necessary condition for coercion. As a descriptive, or nonevaluative, account, Rhodes is able to identify coercion independent from normative judgments. He argues that it is not the wrongfulness of some conduct that makes it coercion, instead, it is the coerciveness of some conduct that makes it wrong. Unique to Rhodes's account, coercion is not necessarily wrong. As a descriptive account, his view permits an independent analysis of the moral status of an act of coercion. The book concludes with a discussion of the normatively significant variables of a coercion claim.

News media reports on eminent domain often highlight outrage and heated protest. But these accounts, Debbie Becher finds, obscure a much more complex reality of how Americans understand property. Private Property and Public Power presents the first comprehensive study of a city's acquisitions, exploring how and why Philadelphia took properties between 1992 and 2007 for private redevelopment. Becher uses original data-collected from city offices and interviews with over a hundred residents, business owners, community leaders, government representatives, attorneys, and appraisers-to explore how eminent domain really works. Surprisingly, the city took over 4,000 private properties, and these takings rarely provoked opposition. When conflicts did arise, community residents, businesses, and politicians all appealed to a shared notion of investment to justify their arguments about policy. It is this social conception of property as an investment of value, committed over time, that government is responsible for protecting. Becher's findings stand in stark contrast to the views of libertarian and left-leaning activists and academics, but recognizing property as investment, she argues, may offer a solid foundation for more progressive urban policies.

How do people live together in cities shaped by inequality? This comparative ethnography of two African cities, Maputo and Johannesburg, presents a new narrative about social life in cities often described as sharply divided. Based on the ethnography of entangled lives unfolding in a township and in a suburb in Johannesburg, in a bairro and in an elite neighborhood in Maputo, the book includes case studies of relations between domestic workers and their employers, failed attempts by urban elites to close off their neighborhoods, and entanglements emerging in religious spaces and in shopping malls. Systematizing comparison as an experience-based method, the book makes an important contribution to urban anthropology, comparative urbanism and urban studies.

The People’s Property? is the first book-length scholarly examination of how negotiations over the ownership, control, and peopling of public space are central to the development of publicity, citizenship, and democracy in urban areas. The book asks the questions: Why does it matter who owns public property? Who controls it? Who is in it? Donald Mitchell and Lynn A. Staeheli answer the questions by focusing on the interplay between property (in its geographical sense, as a parcel of owned space) and people. Property rights are often defined as the "right to exclude." It is important, therefore, to understand who (what individual and corporate entities, governed by what kinds of regulations and restrictions) owns publicly accessible property. It is likewise important to understand the changing bases for excluding some people and classes of people from otherwise publicly accessible property. That is to say, it is important to understand how modes of access and possibilities for association in publicly accessible space vary for different individuals and different classes of people, if we are to understand the role public spaces play in shaping democratic possibilities. In what ways are urban public spaces "the people’s property" – and in what ways are they not? What does this mean for citizenship and the constitution of an inclusive, democratic polity? The book develops its argument through five case studies: protest in Washington DC; struggles over the Plaza of Santa Fe, NM; homelessness and property redevelopment in San Diego, CA; the enclosure of public space in a mall in Syracuse, NY; and community gardens in New York City. Though empirically focused on the US, the book is of broader interests as publics in all liberal democracies are under-going rapid reconsideration and transformation.
