Territorial sovereignty - the unilateral right of states to control their land and borders - is a fundamental ordering principle of contemporary politics, influencing mobility, settlement, access to land, and freedom. It has long been assumed that democracies require such territorial mastery to achieve self-determination without interference. But what if territorial sovereignty only serves the interests of conquerors and already powerful states? A sharper view of land politics in the modern era shows that territorial sovereignty has not only been established through conquest, but enables and encourages further forms of land monopolization, theft, and colonization. Contested Territory argues that the perplexities of sovereignty should prompt us to explore alternative, non-sovereign territorial form capable of realizing the promise of democracy in the global age. To bring the potential of contested territory into focus, Jurkevics explores themes central to this tradition - land sharing, local land autonomy, legal pluralism, federation, cosmopolitan membership, and anti-colonialism - and probes their compatibility with democratic politics. The author then charts normative foundations for a cosmopolitan, democratic theory of territory. Through a critical engagement with the thought of Hannah Arendt - both her conceptualization of world-building and her rejection of sovereignty - this volume argues that it is both possible and desirable to decouple democracy and territorial sovereignty, and that by doing so we can better respond to the border-defying crises of the global age.

This book considers the possibilities for resolution of the Nagorno-Karabakh Conflict in the context of comparative international law. The armed conflict between Armenia and Azerbaijan over the territory of the Nagorno-Karabakh has been on the peace and security agenda since the dissolution of the Soviet Union. This volume draws parallels with a similar situation between Sweden and Finland over sovereignty of the Aland Islands in the early 20th century. Resolved in 1921, it is argued that this represents a model autonomy solution for territorial conflicts that include questions of territorial integrity, self-determination and minority rights. The book compares both conflict situations from the international law perspective, finding both commonalities and dissimilarities. It advances the application of the solution found in the Aland Islands precedent as a model for the resolution of the Nagorno-Karabakh Conflict, and provides appropriate recommendations for its implementation. islands has emotional content far beyond any material significance because giving way on the island issue to Japan would be considered as once again compromising the sovereignty over the whole Korean peninsula. For Japan, the Dokdo issue may lack the same degree of strategic and economic values and emotional appeal as the other two territorial disputes that Japan has had with Russia and the two Chinas – namely the Northern Territories/Southern Kurile Islands and the Senkaku Islands, respectively. Nevertheless, fishing resources and the maritime boundary issues became highly salient with the introduction of UNCLOS. Also, the legal, political, and economic issues surrounding Dokdo are all intertwined with Japan’s other territorial disputes to the extent that concessions of sovereignty on any of these island disputes could jeopardize claims or negotiations concerning the rest. South Korea and Japan have forged a deeper diplomatic and economic partn- ship over the past decade. A new spirit of partnership after the landmark joint declaration of 1998 culminated in the successful co-hosting of the World Cup 2002. At the end of 2003 the two neighbors began to negotiate an FTA to further strengthen their already close economic ties. South Korea’s decades-long embargo on Japanese cultural products has now been lifted, while a number of South Korean pop stars are currently sweeping across Japan, creating the so-called “Korean Wave” fever. A pragmatic calculation of national interests would thus suggest cooperative behavior.
