The essays in this book tap the potential of the historical analysis of social contexts in which property rights are embedded - social relations, power and agency, political institutions, culture - to understand how landed resources are actually appropriated. This exploratory approach seeks both to take advantage of the existing theory of property rights, as it is applied by the institutionalist outlook on economic history, and to go beyond it by explicitly incorporating social processes and factors in the analysis of property institutions. With this common aim in mind, the book covers a wide variety of historical cases throughout space and time, from the late Middle Ages in the Czech lands and in Tuscany to the very recent de-collectivisation of the countryside in former socialist countries, which will contribute rich and grounded insights to the discussion of the topic and of its implications.

Legislative discussion looks at EU law, the European Convention on Human Rights, the European Social Charter and related case law. The book goes further to examine United Nations human rights instruments and related practice of UN committees. This unique focus allows for a fuller understanding of anti-discrimination law's implications, potential, and challenges.

Nordic Law In European Context written by Pia Letto-Vanamo and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-12-12 with Law categories.

Nordic law is often referred to as something different from other legal systems. At the same time, it is a common belief that the Nordic countries share more or less the same legal tradition and are very similar in their approach to the law. Considering both of these points of view, the book tells a story of how Nordic law and Nordic legal thinking differ from other legal systems, and how there are many particularities in the law of each of the Nordic countries, making them different from each other. The idea of “Nordic” law also conceals national features. The basic premise of the book is that even if, strictly speaking, there is no such thing as a Nordic common law, it still makes sense to speak of “Nordic” law, and that acquiring a more-than-basic knowledge of this law is interesting not only for comparative lawyers, but also helpful for those working with Nordic lawyers and dealing with questions involving law in the Nordic countries.

This volume surveys Nineteenth-century Russian society and economy and finds that Russian institutions, practices and ideas fit the general European pattern for that period of rapid change. Even apparently distinctive Russian features deepen our understanding of 'Europeaness'. In the Nineteenth-century there were still many different ways to be European, and excessive generalization based on the experiences of one or two countries obscures the great diversity that still characterized European civilization. Moreover, these essays bring to light several points at which Russian legislation and thinking provided models and examples for others to follow. The authors focus on key elements of how Russians envisaged and constructed their economy and society. This is an important contribution that increases understanding of Russian history at a time when Russia's relationship with the 'West' is again debated.

European Intellectual Property Law offers a full account of the main areas of substantive European IP law and a discussion of their wider context and effect. The amount and reach of European law, and decision-making in the field of intellectual property has grown exponentially since the 1960s, making it increasingly difficult to treat European law as an adjunct to domestic intellectual property regimes. European Intellectual Property Law responds to this reality by presenting a clear and detailed account of each of the main areas of substantive EU intellectual property law, situated in the context of both the EU legal system and international IP law, including EU constitutional law, the law of the European Patent Convention 1973/2000, and private international law. It draws selectively on examples from domestic IP regimes to illustrate substantive differences between those regimes and to demonstrate the impact of European law, and decision-making on EU Member States. This unique, thoroughly modern approach goes beyond a discussion of the provisions of European legal instruments to consider their wider context and effect. European Intellectual Property Law is the ideal guide for any student wishing to gain a full and critical understanding of the substantive European law of intellectual property.
