La interpretación de los contratos es una actividad fáctica y jurídica, que concierne al entendimiento de las disposiciones convencionales que emanan de la autonomía de las partes y de las normas del ordenamiento jurídico que resultan aplicables al negocio en concreto. El procedimiento hermenéutico ocupa un lugar tan importante como el de la creación del contrato, en tanto que constituye el extremo final de la relación intersubjetiva, donde cobra eficacia el conjunto de intereses que los contratantes han querido satisfacer desde el momento de la celebración. A lo largo de la historia, en los diferentes sistemas jurídicos se han aplicado los criterios interpretativos subjetivos y objetivos, la calificación y la integración, con la finalidad de asegurar que los efectos del contrato correspondan al ejercicio de la libertad de los contratantes dentro de las restricciones que surgen de las normas imperativas y con el aporte de los elementos extrínsecos relevantes. Estos criterios y elementos llevan siglos de consolidación en el campo de los contratos civiles, razón por la cúal conviene analizarlos para definir cuál puede ser su disposición jerárquica en la actualidad, cuál su aplicación a los contratos celebrados por el Estado, y también resulta útil explorar posibilidades en torno o a la función social y a la perspectiva económica frente a la hermenéutica contractual.
