The Criminalization series arose from an interdisciplinary investigation into criminalization, focussing on the principles that might guide decisions about what kinds of conduct should be criminalized, and the forms that criminalization should take. Developing a normative theory of criminalization, the series tackles the key questions at the heart of the issue: what principles and goals should guide legislators in deciding what to criminalize? How should criminal wrongs be classified and differentiated? How should law enforcement officials apply the law's specifications of offences? The fourth book in the series examines the political morality of the criminal law, exploring general principles and theories of criminalization. Chapters provide accounts of the criminal law in the light of ambitious theories about moral and political philosophy - republicanism and contractarianism, or reflect upon on the success of important theories of criminalization by viewing them in a novel light. Ideas that are fundamental to any complete theory of the criminal law - liberty, harm, and the effect on victims - are investigated in depth. Sociological investigation of the criminal law grounds a critical investigation into the principles of criminalization, both as a legislative matter, and with respect to criminalization practices, in contemporary and historical contexts. The volume broadens our conceptions of the theory of criminalization, and clarifies the role of the series in the development of this theory. It is essential reading for all interested in legal, political, and social theories of criminalization.

Contemporary society very often asks of individuals and/or corporate entities that they perform actions connected in some way with the immoral actions of other individuals or entities. Typically, in the attempt to determine what would be unacceptable cooperation with such immoral actions, Christian scholars and authorities refer to the distinction, which appears in the writings of Alphonsus Liguori, between material and formal cooperation, the latter being connected in some way with the cooperator's intention in so acting. While expressing agreement with most of Alphonsus's determinations in these regards, Cooperation with Evil also argues that the philosophical background to these determinations often lacks coherence, especially when compared to related passages in the writings of Thomas Aquinas. Having compared the philosophical approaches of these two great moralists, Cooperation with Evil then describes a number of ideas in Thomas's writings that might serve as more effective tools for the analysis of cases of possible immoral cooperation. The book also includes, as appendixes, translations of relevant passages in both Alphonsus and Thomas.

Pregnancy loss is profoundly complex, ambiguous, and alienating, but telling women who have procured abortions that they are murderers and sinners is not the best way forward. Magisterial teachings on abortion are too often presented as moral absolutes, when in fact moral absolutism distorts the rich wisdom of the Catholic intellectual tradition. This book initiates a new conversation about women’s experiences of miscarriage, stillbirth, and abortion, arguing that we need not approach these difficult life experiences in a simplistic way. Dr. Reimer-Barry argues that both the pro-life and pro-choice movements make important and valuable claims, yet each approach on its own is flawed. Drawing on the framework of reproductive justice together with Catholic social teaching, Dr. Reimer-Barry suggests a new way forward for abortion discourse that takes seriously the full human dignity of women and the intrinsic (though not absolute) value of prenatal life. She argues that instead of thinking of the Church as a moral teacher—with leaders in Rome or Washington, DC dictating to the consciences of the faithful—a better way to address the complexity of difficult pregnancy discernments would be to think of the Church as a community of support in the midst of and after difficult discernments; a community that seeks justice together and implements structural reforms while also providing spiritual care to those in need. What women deserve, is justice.

Rethinking Cooperation with Evil: A Virtue-Based Approach applies Thomistic virtue theory to today's most challenging questions of cooperation with evil. For centuries, moralists have struggled to determine the conditions necessary to justify moral cooperation with evil. The English Jesuit Henry Davis even observed: "[T]here is no more difficult question than this in the whole range of Moral Theology." This important book addresses this challenge by applying the virtue-based method of moral reasoning of St. Thomas Aquinas to issues of cooperation with evil. Those who pastor souls report frequently receiving questions from attentive believers about whether a particular human action inadvertently contributes to some moral evil. Examples of potentially immoral cooperation with evil include whether one may shop at a particular franchise known for its support of abortion, whether Catholics may attend civil marriages outside the Church, or whether an organization may submit to government mandates that health insurance include payment for immoral practices. Although recent moralists have tackled specific topics related to cooperation with evil, agreement on an overall common paradigm has not yet been reached. Rethinking Cooperation with Evil proposes a method for Christian believers and others to approach these questions from the foundation of the thought of St. Thomas Aquinas and the magisterial teaching of the Catholic Church. This text provides both an overall method for how to understand the issue of cooperation, as well as practical counsel for specific cases. Rethinking Cooperation with Evil advances the theological conversation on this topic from both speculative and practical vantage points. To facilitate his argument, Connors utilizes historical analyses that contrast Aquinas's method of moral reasoning with that of the casuist treatment of cooperation. Consequently, the book includes numerous case studies that will be of interest both to moral theologians and readers new to the topic.

Why The Cross written by Ligita Ryliškytė and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-12-31 with Religion categories.

In this book, Ligita Ryliskyte addresses what is arguably the most important and profound question in systematic theology: What does it mean for humankind to be saved by the cross? Offering a constructive account of the atonement that avoids pitting God's saving love against divine justice, she provides a biblically-grounded and philosophically disciplined theology of the cross that responds to the exigencies of postmodern secular culture. Ryliskyte draws on Bernard J. F. Lonergan's development of the Augustinian-Thomist tradition to argue that the justice of the cross concerns the orderly communication and diffusion of divine friendship. It becomes efficacious in the dynamic order of the emergent universe through the transformation of evil into good out of love. Showing how inherited theological traditions can be transposed in new contexts, Ryliskyte's book reveals a Christology of fundamental significance for contemporary systematic theology, as well as the fields of theological ethics and Christian spirituality.

New Essays On Leibniz S Theodicy written by Larry M. Jorgensen and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-02-20 with Philosophy categories.

In 1710 G. W. Leibniz published Theodicy: Essays on the Goodness of God, the Freedom of Man, and the Origin of Evil. This book, the only one he published in his lifetime, established his reputation more than anything else he wrote. The Theodicy brings together many different strands of Leibniz's own philosophical system, and we get a rare snapshot of how he intended these disparate aspects of his philosophy to come together into a single, overarching account of divine justice in the face of the world's evils. At the same time, the Theodicy is a fascinating window into the context of philosophical theology in the seventeenth century. Leibniz had his finger on the intellectual pulse of his time, and this comes out very clearly in the Theodicy. He engages with all of the major lines of theological dispute of that time, demonstrating the encyclopaedic breadth of his understanding of the issues. Leibniz's Theodicy remains one of the most abiding systematic accounts of how evil is compatible with divine goodness. Any treatment of the problem of evil must, at some point, come to grips with Leibniz's proposed solution. This volume refreshes and deepens our understanding of this great work. Leading scholars present original essays which critically evaluate the Theodicy, providing a window on its historical context and giving close attention to the subtle and enduring philosophical arguments.
