'The book is elegantly written throughout and, despite my reservations, I find that it builds a persuasive argument. . . Throughout her book, Craig works tirelessly to persuade us of the veracity of her argument. . . her careful construction of the argument, showing us through judicious use of case law how small shifts in interpretation and attitude can start to make a significant difference, is noteworthy. My anxiety at the reliance of feminist scholarship was unfounded. While its influence is there, Craig's thoughtful use of its authority means that it melds well into the broader focus of her thesis. I finished the book feeling energised and hopeful that there is perhaps a way that we can move from the current rather polarised and polemical approach and expansionary tendencies in copyright law to one that is more principled and balanced. I highly commend this book to you and hope that when you have read it, you will feel as refreshed as I did.' - Charlotte Waelde, Journal of Media Law

Intellectual And Cultural Property written by Fiona Macmillan and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-11-12 with Art categories.

This book focuses on the fraught relationship between cultural heritage and intellectual property, in their common concern with the creative arts. The competing discourses in international legal instruments around copyright and intangible cultural heritage are the most obvious manifestation of this troubled encounter. However, this characterization of the relationship between intellectual and cultural property is in itself problematic, not least because it reflects a fossilized concept of heritage, divided between things that are fixed and moveable, tangible and intangible. Instead the book maintains that heritage should be conceived as part of a dynamic and mutually constitutive process of community formation. It argues, therefore, for a critically important distinction between the fundamentally different concepts of not only intellectual and cultural heritage/property, but also of the market and the community. For while copyright as a private property right locates all relationships in the context of the market, the context of cultural heritage relationships is the community, of which the market forms a part but does not - and, indeed, should not - control the whole. The concept of cultural property/heritage, then, is a way of resisting the reduction of everything to its value in the market, a way of resisting the commodification, and creeping propertization, of everything. And, as such, the book proposes an alternative basis for expressing and controlling value according to the norms and identity of a community, and not according to the market value of private property rights. An important and original intervention, this book will appeal to academics and practitioners in both intellectual property and the arts, as well as legal and cultural theorists with interests in this area.

The symbols, signs, and traces of copyright and related intellectual property laws that appear on everyday texts, objects, and artifacts have multiplied exponentially over the past 15 years. Digital spaces have revolutionized access to content and transformed the ways in which content is porous and malleable. In this volume, contributors focus on copyright as it relates to culture. The editors argue that what «counts» as property must be understood as shifting terrain deeply influenced by historical, economic, cultural, religious, and digital perspectives. Key themes addressed include issues of how: - Culture is framed, defined, and/or identified in conversations about intellectual property; - The humanities and other related disciplines are implicated in intellectual property issues; - The humanities will continue to rub up against copyright (e.g., issues of authorship, authorial agency, ownership of texts); - Different cultures and bodies of literature approach intellectual property, and how competing dynasties and marginalized voices exist beyond the dominant U.S. copyright paradigm. Offering a transnational and interdisciplinary perspective, Cultures of Copyright offers readers - scholars, researchers, practitioners, theorists, and others - key considerations to contemplate in terms of how we understand copyright's past and how we chart its futures.

Innovation Economic Development And Intellectual Property In India And China written by Kung-Chung Liu and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-09-06 with Law categories.

This open access book analyses intellectual property codification and innovation governance in the development of six key industries in India and China. These industries are reflective of the innovation and economic development of the two economies, or of vital importance to them: the IT Industry; the film industry; the pharmaceutical industry; plant varieties and food security; the automobile industry; and peer production and the sharing economy. The analysis extends beyond the domain of IP law, and includes economics and policy analysis. The overarching concern that cuts through all chapters is an inquiry into why certain industries have developed in one country and not in the other, including: the role that state innovation policy and/or IP policy played in such development; the nature of the state innovation policy/IP policy; and whether such policy has been causal, facilitating, crippling, co-relational, or simply irrelevant. The book asks what India and China can learn from each other, and whether there is any possibility of synergy. The book provides a real-life understanding of how IP laws interact with innovation and economic development in the six selected economic sectors in China and India. The reader can also draw lessons from the success or failure of these sectors.

This volume offers a detailed analysis of the issues related to the protection of non-traditional marks. In recent years, the domain of trademark law and the scope of trademark protection has grown exponentially. Today, a wide variety of non-traditional marks, including colour, sound, smell, and shape marks, can be registered in many jurisdictions. However, this expansion of trademark protection has led to heated discussions and controversies about the impact of the protection of non-traditional marks on freedom of competition and, more generally, on socially valuable use of these or similar signs in unrelated non-commercial contexts. These tensions have also led to increasing litigation in this area across several jurisdictions. This book provides an overview of the debate and state of the law surrounding non-traditional marks at the international, regional, and national level. In particular, this book addresses relevant international treaties administered by the World Intellectual Property Organization (WIPO) and the Agreement on Trade-Related Aspects to Intellectual Property Rights (TRIPS) as well as several regional and national legislations and leading judicial decisions in order to examine current law and practice culminating in critical reflections and suggestions on the topic. This is an open access title available under the terms of a CC BY-NC-ND 3.0 licence. It is free to read at Oxford Scholarship Online and offered as a free PDF download from OUP and selected open access locations.

The Indian Media Economy 2 Volume Set written by Adrian Athique and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-12-29 with Political Science categories.

The twenty-first century has witnessed the rise of India as a major media producer and consumer market increasingly engaged with the global economy. Aided by rising incomes, technological remediation, regulatory strategies, and a shifting political terrain, the business of media has been given official recognition as a substantive component of India’s economy and as a prominent feature of its economic thinking. In light of these developments, these two pioneering volumes investigate the dynamics of an increasingly integrated media economy encompassing television, film, music, sport, and telecoms. Volume 1: Industrial Dynamics and Cultural Adaptation illustrates the distinctive industrial dynamics of India’s media economy, tracking the deeply embedded cultural, political, and economic forces that determine its everyday operation. The selection of essays serves to demonstrate the unique patterns of development and the complex field of exchanges that have constituted India’s media economy. As a whole, this volume posits a comprehensive approach to understanding the nature of media resources, the negotiation of industrial norms and the cultural context of a media economy firmly situated in the realities of India’s distinct regions, cultures, and human networks. Volume 2: Market Dynamics and Social Transactions provides a comprehensive analysis of the interlocking markets that constitute the media economy, focusing upon its particular commodity forms, labour conditions, and spaces of consumption. Taking account of a rich set of case studies, this volume argues for the necessary consideration of multiple and interdependent markets in explicating our everyday encounters with media. By foregrounding the social transactions that encapsulate market exchanges, it begins to illustrate some of the novel aspirations, meanings, and relationships arising with India’s media economy.
