This volume offers a systematic philosophical analysis of the normative challenges facing European refugee policy, focusing on whether the response to it can be based on European values. By considering the refugee policy through the lens of European values, cosmopolitan norms and universal human rights, the contributions expose the weaknesses and limitations of existing regulations and make proposals on how to improve them. The EU is often seen as a cosmopolitan project. Europe is supposed to be a community of states that aspires to be guided by cosmopolitan norms. However, the idea of a cosmopolitan Europe has never been unanimously shared, and in recent years, it has come under increasing scrutiny, particularly with regard to the EU’s refugee policy. The guiding idea of this book is that a deeper philosophical understanding of the normative issues at stake can foster greater conceptual clarity and enrich political debates on the future of European refugee policy. The first part of the book revolves around the question of whether the rise in refugee numbers over the past decade has led to a crisis in the EU and, if so, how this crisis relates to or impacts European values. The second part traces the history of the discourse on “European values” and examines from a philosophical perspective how we can plausibly understand these values in terms of their moral grammar, their normative content and their implications for the behaviour of the EU and its member states. Finally, the third part puts forth recommendations for a feasible and normatively more compelling European refugee policy based on human rights, human dignity, justice and democratic self-determination as the decisive normative requirements. Europe is Europe’s last remaining realistic political utopia. But Europe remains to be understood and conceptualized. This historically unique form of international community cannot be explained in terms of the traditional concepts of politics and the state, which remain trapped in the straightjacket of methodological nationalism. Thus, if we are to understand cosmopolitan Europe, we must radically rethink the conventional categories of social and political analysis. Just as the Peace of Westphalia brought the religious civil wars of the seventeenth century to an end through the separation of church and state, so too the separation of state and nation represents the appropriate response to the horrors of the twentieth century. And just as the secular state makes the exercise of different religions possible, so too cosmopolitan Europe must guarantee the coexistence of different ethnic, religious and political forms of life across national borders based on the principle of cosmopolitan tolerance. The task the authors have set themselves in this book is nothing less than to rethink Europe as an idea and a reality. It represents an attempt to understand the process of Europeanization in light of the theory of reflexive modernization and thereby to redefine it at both the theoretical and the political level. In recent years debates about the nature and future of the West have been high on the political agenda. Prognoses of the West’s imminent demise have been countered by those arguing for its continued relevance, or those arguing that while the West will survive its nature, and the balance of power between its constituent units, is transforming. This book argues that understanding contemporary developments requires subjecting the very idea of the West to critical scrutiny and in particular asking what kind of concept it actually is. Locating the West as a discursive concept the book argues attempts to save, fix or reclaim the meaning of the West are illustrative of political agendas rather than indicative of accurate claims about the essential nature of the West. In contrast, the book argues that as a concept the West is impregnated with various discursive legacies, the most embedded of which are those of a civilisational, modern and political West. However, while attempts to define the West’s essence are therefore doomed to fail, given the concept’s historical and discursive flexibility, such attempts reaffirm the legitimising role which claims to the West continue to perform. Beyond this, the book challenges traditional genealogies of the West, which overwhelmingly depict the West as an inside-out concept. In contrast, the book argues that historically outsiders have played an important role in defining the nature of the West and constituting it as a political subject; processes that remain evident today. This book will particularly interest students of critical security studies, critical geopolitics, European politics, American politics and IR theory.

In Justice in the EU: The Emergence of Transnational Solidarity, Floris de Witte argues that European Union law can be understood as an instrument for the elaboration of what justice is, means, and requires on the level beyond the nation state. Approaching the question of justice from the European perspective, however, challenges us to think beyond the contractarian idea that equates justice with national political self-determination. A proper model of justice demands a tiered institutional and normative understanding of justice, involving both the nation state and the EU, which can make sense of the new ties between individual citizens that the process of European integration continues to generate. It also requires that we construct a theory of transnational solidarity that can explain what those new ties tell us about our transnational obligations of justice. This book tackles three issues in turn. It explains which precise institutional and normative structures are indispensable in the pursuit of justice; how the European Union can be understood to increase our capacity for the attainment of justice; and formulates a theory of transnational solidarity that informs the interaction between national and European spheres. Three different types of transnational solidarity are identified and carefully traced throughout the case law of the Court of Justice: market solidarity, communitarian solidarity, and aspirational solidarity. Read together, these three transnational solidarities tell us exactly what justice means in the EU.
