Dabei werden praxisnahe Möglichkeiten in den Vordergrund gestellt sowie Ansprüche an politische Entscheidungsträger formuliert. Alle Zwischenergebnisse wurden graphisch dargestellt um Vermittlung und Präsentation für Entscheidungsträger zu vereinfachen. Zusätzlich gibt es einen besonderen Schwerpunkt auf kulturelle Aspekte der chinesischen Markenpiraterie. Einleitend werden auch positive Aspekte von Produktpiraterie erörtert. Alle Angaben sind mit aktuellen Daten hinterlegt soweit diese zugänglich sind. Hypothetische Schätzungen wurden vermieden. Es wurden ca. 150 Quelltexte ausgewertet wobei die Aktualität der Referenzliteratur beachtet wurde. Abstract: The paper Counterfeiting in the People s Republic of China deals with all aspects of counterfeiting in China. Special attention is drawn on analysis of impact, drivers and containment options concerning increased counterfeiting. Beside a main focus are cultural reasons for counterfeiting. Additionally the paper includes many charts and graphs to support an easy summary or presentation to others. Overall 150 sources were examined and lates numbers are included. Although Chinas counterfeiting issue makes headlines in the economic world, only few research examined the problem in a comprehensive way. Many journalists focus on legal issues and thus mainly on the supply side of counterfeiting. Other researchers simply blame Chinas cultural heritage to be the main cause. Most papers lack a broad approach, which is inadequate regarding the magnitude and scope of Chinas counterfeiting. The objective of the present paper is to give a comprehensive overview about counterfeiting in the People s Republic of China. Comprehensive shall mean that all aspects of counterfeiting are subject to analysis. As such, this paper only covers take-down notices on the example of Alibaba and in a summary manner administrative enforcements as well as preliminary injunctions. This paper does not address any aspects of criminal enforcement or liability. The business with counterfeit products is booming and has been described as the ”crime of the 21st century”. The BASCAP has conducted an investigation on behalf of the ICC with the aim, amongst others, to estimate the economical effect of counterfeiting on a worldwide basis. This investigation came to the conclusion that ”the total value of counterfeit and pirated products” reached $455 billion - $650 billion4 in 2008 and is expected to reach $1,220 trillion - $1,770 trillion in 2015. According to the WCO, the PRC accounts for 71% of all seized counterfeit products worldwide in 2013 (46.6% for China and 24.7% for Hong Kong). The 2013 seizure statistics from the U.S. shows that the PRC is accountable for 93% of all seizures in terms of value in the U.S. (China for 68% and Hong Kong for 25%).

As China becomes a full participant in the international economy, its inability to enforce intellectual property rights is coming under escalating international scrutiny. What is the impact, Andrew C. Mertha asks, of external pressure on China's enforcement of intellectual property? The conventional wisdom sees a simple correlation between greater pressure and better domestic compliance with international norms and declared national policy. Mertha's research tells a different story: external pressure may lead to formal agreements in Beijing, resulting in new laws and official regulations, but it is China's complex network of bureaucracies that decides actual policy and enforcement. The structure of the administrative apparatus that is supposed to protect intellectual property rights makes it possible to track variation in the effects of external pressure for different kinds of intellectual property.Mertha shows that while the sustained pressure of state-to-state negotiations has shaped China's patent and copyright laws, it has had little direct impact on the enforcement of those laws. By contrast, sustained pressure from inside China, on the part of foreign trademark-owners and private investigation companies in their employ, provides a far greater rate of trademark enforcement and spurs action from anti-counterfeiting agencies.
