Increasing demand for Australian seafood overseas and at home is driving both legal and illegal markets, heightening the need for sustainable harvesting and management. Though illegal activity in the Australian domestic fishing industry has long been thought to be small-scale and opportunistic, significant numbers are regularly flouting the regulations. Some organised criminal activity too is evident, in high-value, low-volume fish stocks, such as abalone and rock lobster. Although fisheries management arrangements currently in place may be effective in minimising the risk of low-level illegal activity, there is widespread concern among fisheries officers that the current regulatory environment is not adequate to deal with and prevent organised criminal activity.

It presents key findings of the stage one research and focuses chiefly on illegal fishing activity in the commercial sector. The paper outlines different varieties of illegal activity in the fishing industry, describes the market for high-value, low-volume fish products such as abalone, shark fin and seahorse, and considers whether Australian fisheries legislation and enforcement can adequately respond to the threat of criminal exploitation of vulnerable species. The paper concludes by suggesting possible solutions to this threat, which can only be combated by a range of effective operational, legislative and educational strategies implemented uniformly across jurisdictions and bolstered by international support and cooperation.

Huge quantities of natural resources are illegally harvested and their proceeds laundered in the Asia-Pacific region, fostering corruption and undermining environmental governance. Most illegal exploitation and pollution occurs in countries with poor governance capacities, but much of the sale for profit and money laundering occurs in mature markets with well-developed governance capacities. Their asymmetrical enforcement capacities can complement each other. This book explores ways to combat illegal fishing and logging in Asia-Pacific region by the use of cooperative legal measures, particularly anti-money laundering and confiscation of proceeds techniques. As the threats posed by organised crime and terrorism persist, law enforcement authorities remain under pressure to suppress the movement, or flows, of people and objects that are deemed dangerous. This collection provides a broad overview of the challenges and trends of the policing of flows. How these threats are constructed and addressed by governments and law enforcement agencies is the unifying thread of the book. The concept of flows is interpreted broadly so as to include the trafficking of illicit substances, trade in antiquities, and legal and illegal migration, including cross-border travel by members of organised crime groups or ‘foreign fighters’. The book focuses especially on the responses of governments and law enforcement agencies to the changing nature and intensity of flows. Humans are deeply dependent on fishing—globally, fish comprise 15 percent of the protein intake for approximately 3 billion people, and 8 percent of the global population depends on the fishing industry as their livelihood. The global fishing industry is plagued by illegal fishing, however, and many highly commercial species, such as cod, tuna, orange roughy, and swordfish, are extremely vulnerable. Through criminological analysis, The Last Fish Swimming emphasizes the importance of looking at specific environmental factors that make illegal fishing possible. It examines such factors as proximity to known ports where illegally caught fish can be landed without inspection (i.e., ports of convenience), fisheries monitoring, control and surveillance efforts, formal surveillance, and resource attractiveness in 53 countries that altogether represent 96 percent of the world's fish catch. The book calls upon the global community to address the illegal depletion of the world's fish stock and other similar threats to the world's food supply and natural environment in order to ensure the sustainability of the planet's fish and continuation of the legal fishing industry for generations to come.
