A autora apresenta, à luz da Teoria Econômica do Crime e das Penas, uma análise crítica da política criminal sobre o problema do consumo de drogas. A partir de uma abordagem acerca da questão da droga e suas consequências nos contextos geográfico, político, econômico e sociocultural do Brasil e de Portugal, é construída uma visão pluridisciplinar sobre o problema posto e os principais desafios, obstáculos e oportunidades que o envolvem. Na sequência, desenvolve-se um exame comparativo dos aspectos mais relevantes entre os ordenamentos jurídicos brasileiro e português quanto às penas e medidas aplicadas em relação ao consumo de drogas nos dois países, estabelecendo pontos cruciais e contrapondo diversos posicionamentos a fim de proporcionar uma apreciação abrangente sobre o complexo dilema das drogas e os impactos comportamentais e socioeconômicos que podem derivar da política criminal adotada. Os resultados evidenciam que, não obstante a existência de semelhanças entre os dois países, existem assimetrias importantes nas políticas analisadas.
