Na sequência, desenvolve-se um exame comparativo dos aspectos mais relevantes entre os ordenamentos jurídicos brasileiro e português quanto às penas e medidas aplicadas em relação ao consumo de drogas nos dois países, estabelecendo pontos cruciais e contrapondo diversos posicionamentos a fim de proporcionar uma apreciação abrangente sobre o complexo dilema das drogas e os impactos comportamentais e socioeconômicos que podem derivar da política criminal adotada. Os resultados evidenciam que, não obstante a existência de semelhanças entre os dois países, existem assimetrias importantes nas políticas analisadas.
