The criminal justice system now serves as the chief provider of health care services to a significant portion of society. This includes the provision of physical and mental health care for offender populations who require substantial health care resources. To date, little is known or understood with regard to how these services and programs are being delivered. This book addresses the gaps in our knowledge by presenting a range of studies detailing the daily practices that occur in places where criminal justice and public health systems intersect. This includes an assessment of sheriff agency emergency communication systems, a study of problem behaviours and health using a juvenile sample, the challenge of treating mentally ill prison inmates with note of important gender differences, the impact of case management on justice systems, and a review of substance abuse cessation programs among pregnant women currently serving probation and parole sentences. Also included is a policy piece in which the authors call for an integrated model that is neither criminological nor public health specific. These readings provide a range of empirical examples that highlight important successes and challenges facing the criminal justice and public health systems. This book examines questions of medical accountability and ethics. It analyses how the criminal justice system regulates health care practice, and to what extent it can and should be used as a tool to resolve ethical conflict in health care. For most of the twentieth century, criminal courts were engaged in matters relating to medicine principally as a forum to resolve ethical controversies over the sanctity of life. However, the judiciary approached this function with reluctance and a marked tendency to defer to the medical profession to define what constituted ethical, and thus lawful conduct. However, over the past 25 years, criminal courts have increasingly been drawn into these types of question, and the criminal law has become a major actor in the resolution of ethical conflict. The trend to prosecute for aberrant professional conduct or medical malpractice and the role of the criminal process in medicine has been analytically neglected in the UK. There is scant literature addressing the appropriate boundaries of the criminal process in resolving ethical conflict, the theoretical legal analysis of the law's relationship with health care, or the practical impact of the criminal justice system on professionals and the delivery of health care in the UK. This volume addresses these issues via a combination of theoretical analyses and key case studies, drawing on the experiences of other carefully selected jurisdictions. It places a particular emphasis on the appropriateness of the involvement of the criminal justice system in health care, the limitations of this developing trend, and solutions to the problems that arise from it.

Disease and crime are increasingly conflated in the contemporary world. News reports proclaim "epidemics" of crime, while politicians denounce terrorism as a lethal pathological threat. Recent years have even witnessed the development of a new subfield, "epidemiological criminology," which merges public health with criminal justice to provide analytical tools for criminal justice practitioners and health care professionals. Little attention, however, has been paid to the historical contexts of these disease and crime equations, or to the historical continuities and discontinuities between contemporary invocations of crime as disease and the emergence of criminology, epidemiology, and public health in the second half of the nineteenth century. When, how and why did this pathologization of crime and criminalization of disease come about? This volume addresses these critical questions, exploring the discursive construction of crime and disease across a range of geographical and historical settings.
