"If you could change one part of the criminal law, what would it be? The editors put this question to nine leading academics and practitioners. The first nine chapters of the collection present their responses in the form of legal reform proposals, with topics ranging across criminal law, criminal justice and evidence - including confiscation, control orders, criminal attempts, homicide, assisted dying, the special status of children, time restrictions on prosecution, the right of silence, and special measures in court. Each chapter is followed by a comment from a different author, providing an additional expert view on each reform proposal. Finally, the last two chapters broaden the debate to discuss criminal law reform in general, examining various reform bodies and mechanisms across England, Wales and Scotland. Criminal Law Reform Now highlights and explores the current reform debates that matter most to legal experts, with each chapter making a case for positive change."--Bloomsbury Publishing.

This collection provides a snapshot of big ideas in family law reform. The book asks: If you could change one part of family law, what would it be? This deceptively simple question is answered by 10 family law experts and debated within the volume by expert respondents. The book puts the proposal first, forcing authors (and their respondents) to critically engage with what family law should look like, and where the development of law is needed to address the changing landscape of family life. Globalisation, cultural and religious diversity, the use of technology and changes in societal attitudes towards marriage and parenthood have all had an impact on the continuing evolution of families. As a consequence, the law has some very complex challenges to address in its attempt to regulate the diversity of family life. This book is an invaluable resource for scholars of family law and serves as a pair to Hart Publishing's landmark Criminal Law Reform Now.

The Work Of The British Law Commissions written by Shona Wilson Stark and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-07-13 with Law categories.

The Law Commission (of England and Wales) and the Scottish Law Commission were both established in 1965 to promote the reform of the laws of their respective jurisdictions. Since then, they have each produced hundreds of reports across many areas of law. They are independent of government yet rely on governmental funding and governmental approval of their proposed projects. They also rely on both government and Parliament (and, occasionally, the courts or other bodies) to implement their proposals. This book examines the tension between independence and implementation and recommends how a balance can best be struck. It proposes how the Commissions should choose their projects given that their duties outweigh their resources, and how we should assess the success, or otherwise, of their output. Countries around the world have created law reform bodies in the Commissions' image. They may wish to reflect on the GB Commissions' responses to the changes and challenges they have faced to reappraise their own law reform machinery. Equally, the GB Commissions may seek inspiration from other commissions' experiences. The world the GB Commissions inhabit now is very different from when they were established. They have evolved to remain relevant in the face of devolution, the UK's changing relationship with the European Union, increasing pressure for accountability and decreasing funding. Further changes to secure the future of independent law reform are advanced in this book.

XIV Seen as a whole, however, I regard the work before us to be especially noteworthy precisely because of its illumination of both the social contexts surrounding the law and the ideas which underlie the efforts towards criminal law reform. An analysis of this kind has not appeared until now, to my knowledge, even in the German literature on the subject, so that this book is of great value to ·the German reader as well as the American. B. Particulars In Chapter IV: A the authors give a general introduction into the development of the German criminal law reform. In that connection they recognize the special role of the Christian Democratic (CDU), Socialist (SPD) coalition in the political situation [leading to passage of the reform law]. The authors emphasize the importance of the introduction of a uniform prison sentence [that is to say ·the termination of the distinction between kinds of prison sentences] and the elimination of short term prison sentences, as the main points of the reform in the "general part" of the code. They remark (pages 170; 192) that a uniform concept of the goal of punishment is still lacking, although, when all is said, there is a general agreement on the principle of resocialization.

'... undoubtedly a first-rate companion for any undergraduate or post-graduate law course.' John Taggart, Criminal Law Review This outstanding account of modern English criminal law combines detailed exposition and analysis of the law with a careful exploration of its theoretical underpinnings. Primarily, it is written for undergraduate students of criminal law, covering all subjects taught at undergraduate level. The book's philosophical approach ensures students have a deeper understanding of the law that goes beyond a purely doctrinal knowledge As a result, over its numerous editions, it has become required reading for many criminal law courses. The 8th edition covers all statutory law including the Assaults on Emergency Workers Act 2018 and Domestic Abuse Act, s 71. Case law discussions now cover: Grant (complicity); Barton (dishonesty); Broughton, Field, Kuddus, and Rebelo (homicide) and AG's Ref (No 1 of 2020) (sexual offences).
