Recent years have seen the creation, particularly in parts of Africa, Asia, Latin America, and the Caribbean, of HIV-specific laws that criminalize HIV transmission and exposure. At the same time, particularly in Europe and North America, existing criminal laws are increasingly being used to prosecute people for transmitting HIV or exposing others to HIV infection. The push to apply criminal law to HIV exposure and transmission is often driven by the wish to respond to serious concerns about the ongoing rapid spread of HIV in many countries, coupled by what is perceived to be a failure of existing HIV prevention efforts. These concerns are legitimate. Recently, particularly in Africa, some groups have begun to advocate for criminalization in response to the serious phenomenon of women being infected with HIV through sexual violence or by partners who do not reveal their HIV diagnoses to them. While these issues must be urgently addressed, a closer analysis of the complex issues raised by criminalization of HIV exposure or transmission reveals that criminalization is unlikely to prevent new infections or reduce women's vulnerability to HIV. In fact, it may harm women rather than assist them, and negatively impact both public health and human rights. This document, co-produced by OSI, provides ten reasons why criminalizing HIV exposure or transmission is generally an unjust and ineffective public policy. It has been endorsed by leading HIV/AIDS, human rights, and women's organizations and networks throughout the world.--Publisher description.

Abstract: The HIV/AIDS epidemic has globally impacted people of all race, genders, socioeconomic class and sexual preference. It has had disastrous effects on certain regions in particular, such as Sub-Saharan Africa. The most common mode of HIV transmission is through sexual activity and a significant amount of the first identified AIDS cases were that of men who have sex with men (MSM). Given the nature of HIV transmission, and the identified high risk group (MSM) associated with the infection, this disease has been shaped with stigma and discrimination. AIDS/HIV has become not only a health issue, but also a political issue. This study will provide a detailed analysis about HIV exposure/transmission laws, specifically focusing on California Willful Exposure Law enacted in 1998. This analysis will provide a variety of perspectives regarding the effectiveness of HIV criminalization laws, as well as the impact they have had on the HIV-positive community.

Intimacy And Responsibility written by Matthew Weait and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2007-12-14 with Law categories.

In what circumstances and on what basis, should those who transmit serious diseases to their sexual partners be criminalised? In this new book Matthew Weait uses English case law as the basis of a more general and critical analysis of the response of the criminal courts to those who have been convicted of transmitting HIV during sex. Examining cases and engaging with the socio-cultural dimensions of HIV/AIDS and sexuality, he provides readers with an important insight into the way in which the criminal courts construct the concepts of harm, risk, causation, blame and responsibility. Taking into account the socio-cultural issues surrounding HIV/AIDS and their interaction with the law, Weait has written an excellent book for postgraduate and undergraduate law and criminology students studying criminal law theory, the trial process, offences against the person, and the politics of criminalisation. The book will also be of interest to health professionals working in the field of HIV/AIDS genito-urinary medicine who want to understand the issues that may face their clients and patients.

HIV-positive persons' The Ontario Working Group on Criminal Law and HIV Exposure (CLHE) is awareness and understanding of their state's criminal HIV disclosure engaged in education and advocacy regarding the use of the criminal law law. [...] The majority of the respondents in the survey were aware of the HIV disclosure law with only 20% being unsure and 5% indicating they did not think such a law existed. [...] Lastly, the authors of the study note that awareness of the law was not surprising given that participants access a median of eight information sources about the law with the most helpful being HIV support groups and AIDS service organizations. [...] The most recent study assessed the awareness of 42 gay men about their awareness of criminal prosecutions for the transmission of HIV and whether and how they adapted their sexual behaviour. [...] Key areas of confusion noted in this study include: lack of awareness that HIV transmission between men could be prosecuted building evidence to support a prosecution for those with high number of sexual partners would be difficult to collect the misconception that only those with premeditated intent to transmit HIV risk being prosecuted lack of understanding of the types of evidence that.

Canada has been known as a hot spot for HIV criminalization where the act of not disclosing one’s HIV-positive status to sex partners has historically been regarded as a serious criminal offence. Criminalized Lives describes how this approach has disproportionately harmed the poor, Black and Indigenous people, gay men, and women in Canada. In this book, people who have been criminally accused of not disclosing their HIV-positive status, detail the many complexities of disclosure, and the violence that results from being criminalized. Accompanied by portraits from artist Eric Kostiuk Williams, the profiles examine whether the criminal legal system is really prepared to handle the nuances and ethical dilemmas faced everyday by people living with HIV. By offering personal stories of people who have faced criminalization first-hand, Alexander McClelland questions common assumptions about HIV, the role of punishment, and the violence that results from the criminal legal system’s legacy of categorizing people as either victims or perpetrators. Note: A regrettable error appears on page 22. The number 240 should be 206 when referring to the number of people prosecuted in relation to allegations of HIV nondisclosure. This will be fixed in future reprints.

Throughout the HIV epidemic, criminal law has been invoked to deter and punish sexual transmission. The public health community has not favored the enactment of criminal laws specifically targeting people with HIV, nor endorsed the application of general criminal laws to HIV - but neither has it taken a vigorous stand against them. Meanwhile, governments continue to adopt HIV-specific criminal laws, and individuals with HIV continue to be prosecuted under general criminal law around the world. This comment argues that criminal law cannot draw reasonable, enforceable lines between criminal and non-criminal behavior, nor protect individuals or society from HIV transmission. In the protection of women, it is a poor substitute for policies that go to the roots of subordination and gender-based violence. The use of criminal law to address HIV is inappropriate except in rare cases where a person acts with conscious intent to transmit HIV and does so.

Punishing Disease written by Trevor Hoppe and has been published by Univ of California Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018 with Health & Fitness categories.

From the very beginning of the epidemic, AIDS was linked to punishment. Calls to punish people living with HIV—mostly stigmatized minorities—began before doctors had even settled on a name for the disease. Punitive attitudes toward AIDS prompted lawmakers around the country to introduce legislation aimed at criminalizing the behaviors of people living with HIV. Punishing Disease explains how this happened—and its consequences. With the door to criminalizing sickness now open, what other ailments will follow? As lawmakers move to tack on additional diseases such as hepatitis and meningitis to existing law, the question is more than academic.
