Canada has been known as a hot spot for HIV criminalization where the act of not disclosing one’s HIV-positive status to sex partners has historically been regarded as a serious criminal offence. Criminalized Lives describes how this approach has disproportionately harmed the poor, Black and Indigenous people, gay men, and women in Canada. In this book, people who have been criminally accused of not disclosing their HIV-positive status, detail the many complexities of disclosure, and the violence that results from being criminalized. Accompanied by portraits from artist Eric Kostiuk Williams, the profiles examine whether the criminal legal system is really prepared to handle the nuances and ethical dilemmas faced everyday by people living with HIV. By offering personal stories of people who have faced criminalization first-hand, Alexander McClelland questions common assumptions about HIV, the role of punishment, and the violence that results from the criminal legal system’s legacy of categorizing people as either victims or perpetrators. Young Criminal Lives is the first cradle-to-grave study of the experiences of some of the thousands of delinquent, difficult and destitute children passing through the early English juvenile reformatory system. The book breaks new ground in crime research, speaking to pressing present-day concerns around child poverty and youth justice, and resonating with a powerful public fascination for family history. Using innovative digital methods to unlock the Victorian life course, the authors have reconstructed the lives, families and neighbourhoods of 500 children living within, or at the margins of, the early English juvenile reformatory system. Four hundred of them were sent to reformatory and industrial schools in the north west of England from courts around the UK over a fifty-year period from the 1860s onwards. Young Criminal Lives is based on one of the most comprehensive sets of official and personal data ever assembled for a historical study of this kind. For the first time, these children can be followed on their journey in and out of reform and then though their adulthood and old age. The book centres on institutions celebrated in this period for their pioneering new approaches to child welfare and others that were investigated for cruelty and scandal. Both were typical of the new kind of state-certified provision offered, from the 1850s on, to children who had committed criminal acts, or who were considered 'vulnerable' to predation, poverty and the 'inheritance' of criminal dispositions. The notion that interventions can and must be evaluated in order to determine 'what works' now dominates public policy. But how did Victorian and Edwardian policy-makers and practitioners deal with this question? By what criteria, and on the basis of what kinds of evidence, did they judge their own successes and failures? Young Criminal Lives ends with a critical review of the historical rise of evidence-based policy-making within criminal justice. This book provides the most current thinking on effective interventions in the lives of criminal offenders. Original articles by leading criminologists provide in-depth analyses of “turning points” in the desistance process experienced by criminal offenders. An understanding of the sources of turning points (or interventions) across the life course is vital to assessing their impact on criminal behavior. Three sources of interventions in criminal careers are identified in the literature: structural location, human agency and situated choice. Structural location refers to the social place occupied by an individual in the social structure: including marital and occupational status, education and income, and so on. Human agency means the active will of an individual to change his or her behavior, that is, the decision to stop engaging in criminal activities. In addition, situated choice coordinates the offender’s willingness to end a life of crime with the social structural supports that increase the odds of criminal desistance. This comprehensive book considers all three sources of turning points—structural location, human agency, and situated choice—across the life course of criminal offenders. The book also provides a section on cross-cultural perspectives on the effectiveness of interventions in the careers of criminal offenders. The policy implications of each intervention are considered in individual chapters. In addition, the authors suggest a research agenda to further the understanding of the interplay among the key interventions across the life course. As the incidence of violent crime rises in the United States, so does the public demand for a solution. But what will work? Mark S. Fleisher has spent years among inmates in jails and prisons and on the streets with thieves, gang members, addicts, and life-long criminals in Seattle and other cities across the country. In Beggars and Thieves, he writes about how and why they become and remain offenders, and about the actual role of jails and prisons in efforts to deter crime and rehabilitate criminals. Fleisher shows, with wrenching firsthand accounts, that parents who are addicts, abusers, and criminals beget irreversibly damaged children who become addicts, abusers, and criminals. Further, Fleisher contends that many well-intentioned educational and vocational training programs are wasted because they are offered too late to help. And, he provides sobering evidence that many youthful and adult offenders find themselves better off in prison—with work to do, medical care, a clean place to sleep, regular meals, and stable social ties—than they are in America’s cities. Fleisher calls for anti-crime policies that are bold, practical, and absolutely imperative. He prescribes life terms for violent offenders, but in prisons structured as work communities, where privileges are earned through work in expanded, productive industries that reduce the financial burden of incarceration on the public. But most important, he argues that the only way to prevent street crime, cut prison growth, and reduce the waste of money and human lives is to permanently remove brutalized children from criminal, addicted, and violent parents.

This first comprehensive study of Chicanas encountering the U.S. criminal justice system is set within the context of the international war on drugs as witnessed at street level in Chicana/o barrios. Chicana Lives and Criminal Justice uses oral history to chronicle the lives of twenty-four Chicana pintas (prisoners/former prisoners) repeatedly arrested and incarcerated for non-violent, low-level economic and drug-related crimes. It also provides the first documentation of the thirty-four-year history of Sybil Brand Institute, Los Angeles' former women's jail. In a time and place where drug war policies target people of color and their communities, drug-addicted Chicanas are caught up in an endless cycle of police abuse, arrest, and incarceration. They feel the impact of mandatory sentencing laws, failing social services and endemic poverty, violence, racism, and gender discrimination. The women in this book frankly discuss not only their jail experiences, but also their family histories, involvement with gangs, addiction to drugs, encounters with the juvenile and adult criminal justice systems, and their successful and unsuccessful attempts to recover from addiction and reconstitute fractured families. The Chicanas' stories underscore the amazing resilience and determination that have allowed many of the women to break the cycle of abuse.
